If you're in Texas that's a misdemeanor. A lawyer is definately a good idea, expecially if this is his first offense. He'll be able to make some kind of deal with comminty service and may be able to keep it off his record if he's a juvenile. |

It depends on what state/county/city he is in...different places have different drug laws, some are much more lenient than others. I would recommend a lawyer, though. |

Depends what he is charged with. He is facing Jail time or other serious penalties. If so, then yes you should get a lawyer. If you do not know then you should at least consult one to find out where you stand. Note laws very from state to state so I would not take simple advice off this site. |

Depends on where he lives. Podunk, Mississippi...I'd take a lawyer. San Francisco, California...I'm surprised he even has to go to court. Seems like a pretty minor offense. Tell him to be very respectful, deferential (lots of "yes sirs" and "no sirs") and don't say anything other than to answer specific questions he's asked. Wear a suit, be humble, keep your mouth shut. He'll probably get a small fine. |

He'd be much, much better off with a lawyer. If you're in the US, its his right to be represented by a lawyer. And the saying goes " the guy who represents himself has a fool for a client." is usually way too true. |

In reality according to our constitution he should take a Milita because even being harassed for Marijuana should be cruel and unusual punishment. We had a constitution that would stop criminalizing the citizens for no good reason. Apparently the biggest crime in your brothers case is the law itself. Tell him get a lawyer no matter what state, a lawyer can get it dismissed! |

If it is his first charge have him ask for a plea bargain like a 6 month deferred, and for him to promise not to get in trouble again, they will keep it off his record. That is only a misdemeanor anyway....
A lawyer will only take his money, this is not a huge deal, he should be able to cop a nice plea with the county/city attorney. |
