Cell phone laws of calif.?

I was sitting at a red light and my phone rang I picked it up told the person i'm in the car I will call you back an hung up the car was not moving but a sheriff pulled me over an gave me a ticket is he wright did I break the law????

Yes, you did break the law. As of January 1, 2008, it is illegal to use a cell phone while operating a motor vehicle, unless you are using a "hands free" device. Sitting in a running car at a red light is operating a motor vehicle.

The engine was on, and the car was on the public road so legally you were "operating a vehicle" and you can be given a ticket. The same logic goes if you unbuckle the seat-belt. If the car is moving or not, it's irrelevant.

The next time you should ignore the call.

yes you broke the law, just because the car is not in motion doesn't mean you were not driving, imagine if you were drunk puking out the window while stopped at a light...you would still be guilty of a DUI right?

Next time hit the speaker phone button and don't have the phone up to your ear, or better yet don't answer the phone, you do have caller id don't you?
