My suggestion would be to go out and buy a very nasty looking knife. After you shoot the intruder, place the knife in their hand (unless they are wearing gloves...) and take it out again. When the cops ask, tell them that the burglar was carrying a knife and threatened you.
Many of our laws defy common sense, but our justice system is just like any other system. Those that make the system work for them benifit. Those that try working against the system just waste thier energy. |

Look, with the advent of privately owned prisons it makes more sense to lock people up than to let them go free. There are huge profits to be made running private prisons.
It's a great way to steal tax dollars, locking up innocent people. Why do you think the USA has the largest prison population in the world? Land of the free? LMAO |

it doesnt seem right does it?? I guess I would just aim to hurt them, like in the leg, and not aim to kill, at least it would slow them down. You could always say they were coming towards you and you thought they were attacking you. its sad when the laws protect the intruders |

The burglar doesn't deserve to be shot dead by you. Since they were unarmed, were they even attacking you? Or were they just taking stuff and were surprised to see you and you could've just run out of the house? And why do you own a gun anyway? Are you a paranoid nut case?
You're not the judge and jury rolled into one and that's why we have laws to protect our society from half-a-brain panicking people inciting vigilante anarchy. I'm happy for you to go to jail for your crime to preserve our legal system for the protection of us all. If you can't live with it, go live in Sudan, Africa. |

Breaking in is not a bodily threat by itself.Your scenario is custom made so to speak to support your position. Nothing is wrong with defending yourself or family. but it had better be for the right reasons. Not just because you want to kill someone. Sorry, you paint yourself as the violent criminal here. I own three nice(and lethal) handguns and a very intimidating shotgun. I legally carry a concealed weapon. I am NOT eagerly hoping someone to attack me and mine so I can shoot them. I hope I never do but I will if I have to(without hesitation). That's why my taxes pay the police, their PROFESSIONALS with training and the experience. 911 will always be my first choice. So please stop giving the rest of us gun owners a bad rep . |

Yes we have that in Australia. Basically if a burglar breaks into your place you are only allowed to use a maximum of EQUAL strength to defend yourself against him (in other words if he's armed with a taser you can use something up to the equivalent of). Ridiculous. |

If we are gonna change the law we got get off our buts and put a fuss like all those liberals. We may have to give up our day job though. I live in MS though and we used to have to drag the body in the house after they were shot but our law was changed now we can shoot them. |

Where do you live? I've never heard of such a law. Legally, you are allowed to defend yourself in your home. Just shoot them, then say you thought this person had a gun or a knife. Remember, it's not a lie, if you believe it. |

We have a very messed up legal system that coddles criminals while persecuting law abiding citizens. Sadly, the best way to keep yourself out of prison in the situation you described is to shoot the perp dead then plant a knife on his body and claim self defense. |
