Why wasn't his death sentence reconverted to the Death Penalty when the state of California brought it back? Why was his sentenced changed to Life in Prison in 1972, but not reinstated in 1992 when the death penalty was?

goz is close. It is not a matter of cost. The statute under which Manson was convicted was found to be unconstitutional. It would be a violation of the constitutional prohibition against ex post facto laws for him to be tried under a new, constitutional statute which was not in effect when the crimes were committed. That would be true even if such a new trial were free. |

A defendant has to be sentenced under the law that was in effect at the time of the crime. The law imposing the death penalty that was in effect when Manson committed his crimes was found to be unconstitutional and his sentenced was automatically converted to life in prison. Laws enacted after the crime was committed cannot be imposed against the defendant. |

What the California supreme court found was the current due process back then to convict a person to death was unconstitutional; latter on the state made changes to the due process of a person charged with the death to accommodate the new requirements, therefore in order for him to be consider eligible for death sentence under the new due process he would have to be tried all over with the new rules, this is cost prohibited |
