Why should anyone be sued? It was an accident wasn't it? Gun shouldn't be in any home with children anyways. I don't like them. Where were the parents? Why weren't they supervising their kid to begin with? |

It all depends on how they got the gun. Was the gun locked up or put away out of sight? I think the age of the children might make a difference. It is a good chance that no one can be sued because it was an accident. In order to sue you have to show negligence. The negligent party could be sued. A young child probably wouldn't know better. An older child should. Also the child that was shot would have to show damages. It would depend on how severe the wounds were or if the child was emotionally damaged.
Without knowing any facts I would guess the homeowner would be the one sued if the gun belonged to them and they did secure it properly. The parents of the child who pulled the trigger would only be libel IMO if it was their gun and they didn't secure it properly. That would be negligent. |

Legally, I don't know exactly how this would pan out, but ethically, no parent or guardian should be so careless as to leave children with the opportunity to access guns, let alone the chance to shoot them. The homeowner and the individual providing care and supervision for the children should be seriously questioned and punished apprpriately. |

The homeowners I would give a life sentance for owning a gun ,if thats not bad enough it was loaded and loose around the house (not under lock and key) .You 10 years for knowingly going to a household who own guns..You havnt said how old the Child is.. over 10years old he knew he should not touch guns at anytime |

my dad keeps his Magnum under his bed, and i know it is loaded, but that thing is locked like Ft. Knox. It has this little thumb scanny thingy. His 12 Gauge also has it. Now if i fired either of those guns it would be his fault since hsi name is on the gun license, not mine. even though i pulled the trigger. |

The owner of the gun should have charges brought against them for negligence and child endangerment. Especially if the weapon was available to children as it obviously was. This person has absolutely NO business owning a gun if they're that irresponsible!!
Why should the parents of the child that pulled the trigger be sued? THEY didn't do anything wrong, and I'm sure the curiosity factor got the best of their child. It's not their fault, it's the gun owner's fault.....1000%!!! |

Let's put this into perspective. The child's parent could have been cleaning the gun and put it down to go to the bathroom and the children could have come in the room and picked up the gun and accidently shot it. I guess that would be criminal negligence by the parent and the parent would be sued. Now, if the child brought the gun to the other friend's house and he accidently shot the other, the child that did the shooting would be placed in protective care for psychological evaluation and the owner of the gun would be questioned and would probably have to pay the medical bills.
In this case the gun is the culprit, not the child. How the gun got into the child's hands is what will be questioned. |

I believe the parent of the child could sue both the homeowner, the owner of the gun and possibly the parents of the child who pulled the trigger. The first two are the most likey and the third will most likely get thrown out, but still a possibility. |
