i posted this question once but need more input
my fiance and i had to file bankruptcy cause of Fords "cutbacks"...anyway we were buying a modular home before the fall of the economy but now have to give our home back..
we live in Michigan and the bankruptcy lawyers dont know their *ss from a hole in the ground...
we are giving up the home, not paying mortgage payment, lot rent cause unemployment just isnt enough...
anyway by law how long do we have? do we have to b served with a notice?
i know we have to move and are packing as i type but in the community where we live we have seen where peoples belongings have been thrown on the streeet...we dont want that to happen...
we asked the bankruptcy lawyer if we will get certain amount of time, if we would b served papers and he said "you should, maybe, be prepared"..
we are two adults (no kids)...how long do we have to move according to michigan law (its a modular)?

first off i would like to say i am very sorry for you. i dont know your staes laws on this but in pa where i live it takes about 3 months. but if i were you i think i would be looking real hard for a place to move. no matter what state you live in , they dont give a damed about you. i am retired and i own my home but when i was young and working and trying to raise a family i came close several times of loosing everything. now i have to worry about being able to pay my property taxes or i still could loose everything i worked for all my life. so i do know where you are comming from. but i take it that you are still young, you still have time to make a comeback and i know you will. good luck and dont give up thays the only way you can truly loose. |

I think for one you get an eviction letter. Also I do not believe that they would just throw your stuff out the house. Thirdly, unless you have received the eviction notice and have not not made any attempt to leave then I guess the state martial comes in, tells you to leave with only your important belongings, it happened to me when i was little. But all in all no, they do not have the right to come in and kick you out like that unexpectedly. They will always give a notice before then. This applies anywhere in the U.S.. Pretty much what is going to happen you will get a notice and then you will find out your time limit, and a side note this will horribly damage your credit and it is a horrible time for that to happen right now. I would prepare all my stuff to be packed and put it in some kind of storage facility. |
