I have to appear in court for a minor in possession charge for 3 grams of marijuana, there is a major catch though, I was not ticketed at the stop, I was mailed a petition to appear in court..? here is how it happened..
I was pulled over for loud exhaust, I wasnt even explained as to why I was being pulled over before he pulled me out of the car saying I was breathing heavy.... he asked me if I had anything pointy in my pockets and I said no, and I also stated I did not consent to a search, and he still proceeded to grab my hands and shove his hands in my pocket and pull out marijuana. I know I had the weed on me and I should be charged, but it wasn't legal, I hadn't smoked any that day, and it didn't smell like weed in the car, where was his probable cause?
will this hold up in court? what will I get for this if it happened in michigan, and should I go before the judge, referee, or jury? and whats with the petition, everyone I know who was written an MIP was issued a ticket on the spot. I think it has something to do with the cop not reliezed I was a minor until he impounded my car and we were half way to the station.
please avoid saying anything like I deserve this ticket, because in actuality I would deserve it if the cop had found it honestly and legally.
