here the story i was on my way home one day i hadnt smoked enything and a cop pulled me over for a loud exhaust
befor i could say enything he asked me to get out of the car (note at this point he didnt tell me what i was being pulled over for and he shoved me against car and shoved his hand in my pocked and pulled out a dime sack and the later earlised i was a minor but he impounded my car and stuff enyways and it said nothing about the marijuana on the ticket and the loud exhaust ticket was dropped in court but i got a thing in the mail saying i had to go to court for something else and when i went in to court they said i had the right to plead guilty or not guilty (but they never said what i was being charged with) and i was given another court date and when i went in that time i talked to referee and he told me it was a possesion charge so i asked for a court appointed attorney but he told me i couldnt have one because it was a traffic violatoin.... this makes no sense to me
are the following the law and if so Why can i have a court appointed attorney and if its a traffic violation why is it a marijuana charge??? what should i do???

before you stepped out of the car you should have asked the cop why he pulled you over, and why he needs you to step out. Contact NORML, they have lawyers who know every rule regarding marijuana possession and illegal searches. They'll give you all the information you need.
A few years ago you'd easily be able to get off because this was an illegal search (you were pulled over for a completely different reason). Now though, the Patriot act has given cops all sorts of loopholes when it comes to illegal search and seizure. |

As long as you can show it was an illegal search, the weed is illegal evidence. You should be fine: the cop was not allowed to find it, so in eyes of the law, the weed does not exist. |
