Copyright laws for posting videos from plays on youtube/vimeo?

I recently made a video for my cast from "MY FAIR LADY" which we did at a local community theater. I did it as a gift to my cast, as a non profit demo reel for them to take with them in the future. The video includes appx 3-4 clips from the play, only 3 with audio, and its only dialogue.
Am I breaking any copyright laws?

Strictly speaking, incorporating copyrighted video and audio into your demo reel is copyright infringement. Whether or not your demo reel is non-profit is absolutely irrelevent with respect to copyright infringement. That being said, you use of the copyrighted content may be excused under a fair use defense. However, fair use is impossible to address in the abstract with any reasonable certainty.
Copyright issues aside, if you are merely distributing the demo reel to your cast (I assume a relatively small number of people), how is the copyright owner going to find out about the video? And even of the copyright owner did find out about your demo reel, you really think they would spend thousands of dollars to pursue an infringement action against you? I'm a bit confused here about what you're worried about, as a practical matter. |
