Could my family sue the nursing home?

Okay so my Grandma had a heart attack awhile ago, and got really weak in the hospital. She also lost alot of weight. So they sent her to the nursing home to get better. Well when she's in the nursing home, after a couple of days she starts losing weight again. Finally, they sent her home. But like a week later she gets very sick! So sick she can't even get off the toilet without any help! Oh and she went to the bathroom in her pants 3 times because she could not get up to go!
So they took her to the hospital, and after 2 or 3 days they moved her to intensive care. We then found out that she was sick because she caught an infectious diseasee from the nursing home. Somebody didn't wash the sheets right, and the last person who used the sheets had that disease.
My Grandma just died Wednessday because of that. So could we sue the nursing home? Additional Details You know what? Shut the F**K UP!!!!
Okay it's not like that's all I'm thinking about! God! I'm just asking a simple question which if you don't want to give a real answer to, you should not answer!
It's been a week, the funeral and wake were today and yesterday. I just said my last goodbyes.

In theory yes,
For negligence, you need 3 things, duty of care, a breech of that duty and the breech caused damage or harm,
there was obviously a duty of care and if the courts rule it was breeched (likely) then there was obviously harm caused,
so you have the basis for a negligence claim
but... because it resulted in death, it may be possible for it to be gross negligence, which means the breech was extremely bad, and others of the same profession/situation would agree,
this would mean that the nursing home would be criminally liable instead of just in civil law, it may mean more gets done about the nursing home too,
just a word of caution, the courts are often reluctant to bring any claim against health care professionals because of the stress they are placed under and the work that they do, they will only allow the claim if the care was seriously, palbably, inexcusably bad,

Here's my two cents worth
First of all, I am sorry for your loss.
I read your words and carefully thought about them.Your grandmother lost weight in the hospital as well as in the nursing home. Mainly due to the heart attack which makes her weak, and not wanting to eat much. She continued to lose weight even when she was home. It looks like she didn't have much help at home either.
Shame you didn't mention the infectious disease and more info on it.
You may need proof from her doctor that that is what she really died from although I suspect it was really her heart. |
