You are in charge of a drug company and you're holding a patent for a drug. The patent lasts for 15 years and it's only the 2nd year of the patent. 13 more years to go. Suddenly an epidemic broke out and only the drug that you're making is he one which can cure the disease. People are demanding that your company give up the patent so that other companies can also make the drug. What will you do in this kind of position?

You don't have to give up the patent to have other companies make the drug.
You simply issue licenses for them to produce it.
Since you still hold the patent, if they exceed the scope of their license agreement after the epidemic passes, you have grounds to sue them.

Simple, call a summit of all the other drug companies big enough to handle it. Offer them a 100 year licence to manufacture your product. Agree a minimum price for it and take their money. Suddenly you have the capacity to supply and you have in the bank all the profits you expected to make and you still will make a profit on all that your company makes and sells. Drug companies need to see a large profit on every product to cover the colossal development costs. Doing it this way means that you have masses of development money available. You also have the power to leak a name and shame document on any companies that do not sign up should there be a shortfall in supply. Quite in the driving seat I think. |

As a human i would give up the patent. As a businessman I would sell off the rights to the patent or increase my work for and mass produce the drug. Either way I would make sure the drug was able to be dispersed. |

dont give up the patent, just make more of the drug. people are saved and your company makes money.
noone has ever had to 'give up' their patent for drug production.
