I have my daughter (5) in my custody, She has lived with me in Colorado her whole life. Her father moved 250 miles away when I was pregnant, I had little contact with him the first 3 years, the last 2 years he has been driving to see my daughter for supervised visits. 6 months ago I took a temp job and moved to where he is for it. I told him then it was a temp situation I would be here for 6 months.My job is over and Im ready to return home, but in February he filled custody with the courts here. He is only seeking every other weekend, which is fine with me. We had temp orders set and he gets day visits gradually increasing to every other weekend. The judge said that my need to relocate will be addressed at permanent orders in July. As I don't know anyone here, and I have been planning to move home since I got here, I have giving notice at my apartment, and my husband has giving notice at his job. Since the judge told me I have to stay in the metro area (which is not my permanent home by any means) what will happen if I move home anyway? He doesn't want full custody, but he may ask for it if I move. Will the courts take away my baby for that? What kind of legal repercussions are there?

Where I am now and where I want to go are both in the same state. They are just 250 miles away and in different counties. I know it's a very legal question I was just hoping someone had been through it! Thank You all for you thoughts.

i would talk to your lawyer about that. if you move away, they might take your daughter.

i assume you already have a court order in colorado. if this is correct, the colorado court has continuing, exclusive jurisdiction over the child. (with some exceptions) the judge cannot compel you to remain in the state in order to keep your child. if there are colorado orders, there is a serious legal question as to whether the judge in second state had subject-matter jurisdiction over the child to enter any orders. this is a complicated situation and you really should consult a lawyer knowledgeable about interstate custody issues. |
