Daughter's father passed away & did not leave a will in Breathitt Co,Jackson KY,can she get the land?

My daughter's father died & left no will and would like to claim his land in this State, What will she have to do to claim it? He had two other children but they were adoped by someone else and he signed the papers. Would they have any rights to the land? Is it going to cost a lot for lawyers to claim what should have been hers? Thank you in advance for any help you can provide me with!

You should consult a lawyer on this. But, in general, if there is no will, the surviving spouse is the heir. If there is no surviving spouse, the child(ren) would become the heir.
In your case, since the other children have been adopted by someone else, there are no legal ties between your father and these children. They probably would not have a claim on his estate. Again, consult a lawyer to be sure about this. |

Sorry but there is no simple answer. If he was married at his death the whole analysis changes. She will need a lawyer to have his estate submitted to a probate court and the probate court will decide what to do with it based on state law. There is also the question of how he held title to the land, and any mortgage rights.
Lawyers fees are negotiable and not carved in stone. If the job looks easy, the fee is less. |

That is really sad news, I'm sorry to hear about this news for your daughter- I hope that you are also trying to comfort her for the loss of her Father while you are worrying about what she is or is not entitled to. |

Someone needs to be appointed to administer the estate before she will be able to claim anything. Speak with a lawyer who handles wills and estates.
Children who have been adopted by someone else would not have a claim to his estate. |
