Difference between public law and private law (UK)?

Hi, I'm a little confused as to the difference between public law and private law. How do I know if something is a public law matter rather than a private one? Please help! Thanks in advance.

"Public law" is a subdivision of Civil Law. Public law has to do with actions involving public bodies, like local councils and central government. It also includes things like Human Rights and Judicial Review.

You don't normally hear "Private law" spoken of as an area of law (the opposite of public law) - but in the public/private sense, private law would be everything other than public law, within civil law.

Alternatively - are you refering to Public and Private legislation? Acts of Parliament can be Public or Private - most are general public acts, but in the late 19th century there were a lot of private acts of parliament used for things such as incorporating companies, building railways etc. Acts will be clearly identified as public or private by their wording. The principle difference is essentially that private acts deal with a few specific people or with one area of land - that sort of thing.

You mean criminal or civil?

Okay, civil law normally deals with private actions, torts, negligence, slander, libel, contracts, wills, property etc. Civil courts tend not to jail people, the usual "punishment" for liablity is payment of money to the complainant.

Criminal law deals with crime and punishment.

In a common law system like England, not all laws are written in statute, in either criminal or civil law. There is no statute specifying murder as a crime in England. It is a "common law" crime. Civl law depends on a case history to determine what the law is, in the absence of statutory direction.

Private law is primarily about the law governing relationship(s) between individual "natural persons" who voluntarily enter into legal transactions of one sort or another. ( A natural person is what a non-lawyer would call a single human being )

Public law by contrast is the (set of ) law(s) that apply to people generally and to organisations that the law recognises as legal entities.(this includes Government bodies )
