I've ordered large amount of vintage clothing from Uk vintage supplier.
Ordered by phone,previously finding about the company on internet..
The owner asked to pay afront for whole order.WE pay £ 2000.Owner promissed to have a stock within the week.After that we set the date to collect the good from his warehouse.When we arrived the owner wasn't there nor our stock.(we traveled from London to North)Then he called us to say he has a problems with customs.Since then we have been waiting 5 weeks and there is no stock for us.The owner called few times and basicaly lied each time.We contacted the local police but they said that this is a civil matter.
Last week the owner agreed by phone that he will provide us with goods or he will refund our money-again this was a lie!I asked him for a refund but he refused.Can I take him to the court?
I did a research and find out that the guy(owner of the vintage company) was jailed for street robbery like also fraud in the past,has a court case against him,.Also every 9 months he is closing and opening the company under changed name.
We paid via bank transfer into his bussiness bank account ,we have all email ,proofs ect.Basicaly he is keeping our £ 2000 over 5 weeks now and he said that if I do not want those goods he will take me to the court as he spent the money for my order.Can I take him to the court for the money he is owning like also the interest and potential loss of earnings?(I could take a stock from different suppier and make a money by now)?

Yes you can take him to court to return your money.
Initially (if you haven't already) give him 7 days to deliver goods or return money.
On the 8th day file a claim with the small claims court - can be done on-line.
If you want to claim for loss of earnings etc then for that I would advise you get a solicitor involved.2 |

You most certainly can take him to court. He has yet to provide any indication of intent to fulfill his part of the contract. |

You could sue him for breach of contract, however if he is trading as a registered company, you will have to sue the company and you probably won't get much joy....if you can sue him personally it'd be better and yes you can claim for interest...not sure about potential lost earnings though. To sue someone you need to have a quantifiable sum you say is owed....potential lost earnings is too vague. If he has the goods, why hasn't he delivered? he's a shyster - go get him! |

Gather up all your records, all your paperwork, all the e-mails, every little bit. Go see an attorney. You definitely have a case. At the very, very least you'll be getting your money back. Let the attorney know you've done research already on this guy and found out he has prior convictions and that he's frequently changing the name and location of his business. Your case with him might be civil, but what he's doing is fraud. |
