Do I have any rights as a father?
|
I am 25 years old, I My ex girlfriend haas given birth to my son, but she refuses to put my name on the birth certificate. We split up half way through her pregnancy and i've only seen him twice since he was born. But he is making demands for money which i can't afford to pay.

nope - u got no rights at all afterall define parental responsibility and yer not on birth certificate either? possibly why your name hasn't been placed on the birth certificate is because yer ex-partner wants to conceal the identity of the true father from the child - it's a control thing really, fear of being alone when she's older and dying. but for the sake of her own happiness she will never be happy it's just a temporary fix from her problems. But for you looks like yer gonna go through a ****** hard time. There's lots of girls out there who just want a child and NOT the father hanging around and it's something people just don't tell u about
society encourages the family unit to be broken - father's for justice the campaign group was told to stop what they were doing cos of the publicity they were getting as many fathers who are denied contact were not going to see solicitors and going to court as they thought "what's the point?" This left people in law jobs with little or no work. family breakdown makes people suffer but it also creates lots and lots of jobs. people benefit from the misfortunes of others unfortunately
she quite sounds quite an evil girl especially asking for you to pay money that u can't afford - i guess she wants to screw u right down
if u lose contact tables always turn - when the child's older and learns about his dad the child will have soo much bitterness for her that he won't wanna know her thereby leaving her to rot in her old age with little or no comfort at all, 'dying in the cold'
good title for song that - dying in the cold
p.s. if u wanna chat about what yer going thru mail me if u want
p.p.s. no-one has rights - they are an illusion |

you have full rights.
have you seen the baby so little because you dont want to see him, or will she not let you see him?
if you show that you are a devoted father and want to be involved with the child's life and upbringing, then you have no worries.
It's only fair for you to pay child support, after all you did make the baby, but how much, I'm not sure.
you have every right to have your name on the birth certificate, but please dont miss out on your son's life to get away from an annoying ex.
Get some legal advice, or try and speak to her first. If she refuses or is still making demands, tell her to speak to your solicitor. |

She doesn't have to put your name on the birth certificate but as the biological father you will still have a financial responsibility. |

yes you do have rights
but you should take full responsibility and pay for your child as well even if you can only afford a couple of pound a week,
If she see's your making an effort then she might let you be a father without the need to take it further.
Don't give up keep trying, take her some nappies or clothing for him, offer to take him and give her a break. anything to prove your commited to your son
Good luck |

If your name is on the birth cert, you have as much right as the mother, if your name is'nt then go for parental responsibilty ,you need to speak to a solicitor, if shes playing hard ball, |

Yes you do have rights as a father, but if you want rights you also need to contribute to this boys up bringing, you cannot have it always and every way , suggestion, see a Solicitor, go to court, establish your parental rights and get a maintenance order for your sons support, plus visiting rights if that is what you want. |

Been there Dave. First of all, keep sending her money, whatever you can afford. It shows the court you are responsible and if you stop paying, she could come after you later for back support. Her refusal to let you see the baby does not remove your resposiblity to pay under the law. If you can't afford a lawyer, you can file a pro se (representing yourself) motion in court without a lawyer to ask for visitation. As long as you are a relatively good person (no substance abuse problems or a history of violence or incarceration) visitation is pretty much automatic. If she refuses to comply, she can be arrested at some point. The birth certificate thing is minor, unless she denies you are the father, you have parental rights. If she does deny you are the father, you would have to ask for a DNA test. Unfourtunatly whoever requests the test usually ends up paying for it.
Good luck and don't give up. |

Yes, you absolutely have rights. Do not give her ANY money if she is denying you parental rights. Find a legal aid association in your area and apply for legal assistance. They will give you free legal services if you aren't able to afford an attorney on your own. Have the attorney petition the court for a paternity test to legally establish you as the biological parent, then sue for your parental rights and visitation. If you do this, the court will order you to pay child support as a term of your rights. And once there's a court order, it won't go away until the child is an adult, so make sure you'll be ready to pay the child support. If you stop paying at any time, you won't be entitled to your rights, and they can charge you criminally, or issue a withholding order that will deduct support directly from your paycheck before you receive it, just like taxes. But as long as you comply with the court, you absolutely have rights. |

yes u have rights...go and see a lawyer..say you want a paternity test...until you do your name will not go on birth cert. ... the mother has no right to ask for money until this is done...legally...when tests are all done then you and your ex will have to come to an agreement of finances...in NZ the court cannot make you pay child support ... your ex has to apply for it either thru a goverment agency IRD, or a private agreement that has to be registered with if you are working .. but please keep to the agreement as this will help with your sons upbringing .. and you can also file for joint custody at the same time... |

It would appear that the onley one with any "rights" is your ex partner.
You will have to pay for at least the next 18 years and she can stop you doing anything else like having contact.
In theory you can go to court to obtain contact but if she's always "not available" on your contact days there's really nothing you can do. |
