Legally, no. Judging by your wording ( "finding out" ) it seems like you're implying that your employer would not approve despite its medical application; in which case I would tell him/her to avoid a problem. If it's for medical purposes why would you need to hide it anyway, right? ;) |

Do you use marijuana with a prescription from a doctor? If you do not have a prescription, you may want to get one.
If your employer drug tests prospective employees, you will need to let them know ahead of time so that it will not be a surprise when you are drug tested. Most employers not only do preemployment drug tests, they also do random drug testing after employees are hired.
Marijuana has a propensity to remain in the body for an extended period, even after you have stopped using. For some positions, or some companies, it doesn't matter that you would not actually be high while at work. Any company whose employees must make decisions involving the safety and well being of their customers, must be extraordenarily careful. So....yes tell them in advance. |

NO!!!!! do you have to tell them if your taking anti-depressants? no. That would violate your rights as a person. If they drug tested you and you were dirty and fired you, you can sue them.
You don't have to tell an employer about a medical condition that won't affect you at the workplace. |

Well, if your employer has mandatory drug testing, it would be in your best interest to let them know before you get caught on a drug test. If you live somewhere that medical marijuana is legal, then I imagine it won't be to much of an issue. If it's not legal where you live, then you may have some problems. But it's always best to be upfront about rather than to be found out. |

Medical marijuana is a touchy subject. Despite what your state government says, it is still illegal. Federal law has determined marijuana use to be illegal, regardless of what your doctor or (unfortunately) what state governments say. That means that if you get pinched by a drug test, you are gone, prescription or no prescription. However, I don't think you are legally obligated to divulge that information unless pressed to take a drug test. |

If the make you take a drug test they can find out. However I've never seen it on a job application. Keep in mind that they can make you take a test if you have an accident at work too. |

Not unless you have to get tested for work.... (I'm a social worker at a rehab center and I have to get tested periodically just to make sure that our clients are in good hands) Otherwise, I don't think there's any reason for them to find out, unless you feel more comfortable letting them know. Are you using medical marijuana with a prescription? If so, you could always ask your doctor to give you a note for you to take to work. |

If you need to take a drug test, or they do random tests, I would.
If your job required you using any kind of machinery, or it is a type of job you are more likely to get injured at, I would (because they will probably drug test after you are injured).
Are you required to? Nope.
But, it would be best to tell them so they do know the situation. I would make sure you have a note from your Dr. explaining everything beforehand.

If they drug test you it would be best to tell them ahead of time so you don't risk your job. You may want to bring a paper saying that its okay for you to use it.
Otherwise no you don't have to tell them that. You should tell them but you don't have to. |

does your company require U/A screening? if so then i would suggest that you bring it up as well as your prescription. and just so you know. if you use daily as a medicinal user likely does then you ARE under the influence. Just not necessarily BAKED! |

Some companies have extremely tough rules about drugs, any drugs. Surprise piss tests are a way of life at some companies. Can't even have a beer at lunch. |

im curious why none of your response regarding my medical marijuana inquery, included the hipaa (a federal act) in your responses? im under the impression that if you live in a state where marijuana is recognized as a legal, and is prescribed, then for it to show up in a u/a, and as a result you don't get the job, than that is a violation of hipaa..am i right or wrong? |
