Well, I don't think we should have the death penalty. But the reality is, its the Supreme Court's opinion that counts in this country.

I'm against the death penalty so I agree with their rulling, but that freak better be behind bars for the rest of his sorry life.

I'm opposed to the death penalty anyway. And the punishment child molesters suffer in prison is far worse than any nice, clean execution, so I think a life sentence is much better. But legally, there has to be a line drawn between cases which deserve the death penalty and those that don't. Otherwise, you could have somebody in one state executed for robbing a liquor store, while in another he gets probation. At some point, society I hope will learn that revenge accomplishes nothing but making society feel better about themselves, which is a travesty considering it makes them equal to the criminals themselves.

No cultivated and modern society can accept death penalty by the state.

That´s like living in the Stone Age. How can a state put someone they have in secure custody to death? That´s so outrageous, immoral and a shame.

Lock them up, so the society is safe from the perpetrators. What do we get from cheap revenge? So I agree with the Supreme Court somehow.

I agree. I was molested at the age of 5 by two of my teachers. I am 26 now and have no problems. I'm not justifying rape, but the problem is that it starts with death penalty for raping children...then it will be the death penalty for rape...what's next. There is no reason to get that ball rolling. We already live in a police state as is.

Well if we were to go by the "eye for an eye" idea of justice as is being preached by many many extremists in our society today, even they cannot with only "an eye for an eye" backup say that death is a reasonable sentence, because there is not death involved in the act of rape.

If we are to remain a society of justice and reasonableness, then NO, I could not support the death sentence for even a child rapist.

However, if that child's rape results in the death of the child then without a second though I would be willing to pull the handle myself.

Where there is a capitol offense that involves death either in the committing the act itself or by accomplice then capitol punishment via the death of the individual(s) is justified. ..

However, there is another option. Sanctuary as described in the Bible. A city where people guilty of capitol offenses can go to be protected from the harmed or injuried family. During the persons stay they are given trial. If they are found guilty of the capitol offense the are rejected from the city and the harmed or injuried family can stone the person. If at trial the person is found to have committed the capitol offense by accident without malice then the person is allowed to stay in the city protected from the harmed or injuried family. Every 7 years the person may petition for release with a protected insignia showing they have served their full time and are released from the guilt of the crime. This happens every 7 years for 49 years at which time there is a jubilee year where all who have served their time faithfully are given the opportunity to make petition to the high priest for release. This is a fairly reasonable system. The city must be self sustaining and all of its citizens must contribute to the common good of the city.

It would seem to me a reasonable solution to the problem we have with the nearly 1 trillion dollars a year we spend on keeping people in jail.

Now the question is can we make it work??? With our technologies today I think we can.

Of course if someone die escape from the city. The sentence of death would be carried out immediatly upon capture.

The real problem is that they don't stay locked up...they get off 'for good behavior'. Another part of the problem is that they don't stop...so they get out of jail to reoffend. And if you don't believe me, just read a few of John Douglas' books, he was one of the first FBI profilers.

Sometimes on these children the damage is extensive to their 'privates' resulting in many surgeries and sometimes even death.

How can you justify letting scum like that back on the street only to rape another child. No, I so disagree with that decision. Now there is not a punishment severe enough for what they have done.

Well, on a rapist, not sure death sentence would be the way to go. I am not totally against a death sentence per say, but I don't think that a rapist should die necessarily. If he committed a murder along with the rape(knowingly) then I would think differently.

I'm a liberal and I am against the death penalty, but not for the usual reasons.

Because we really don't know what is on the other side.

Therefore I am not against locking them up for good and in some cases, such as mass murder, lock them up with no human contact, books, tv or even a bible to live out their own version of hell.

As the article satated: "The Supreme Court declared Wednesday that executions are too severe a punishment for child rape, despite the "years of long anguish" for victims."

DESPITE! the years of long anguish of it's victims. D.P. is TOO severe. But yet raping a child isn't sever right? Or raping any aged woman for that matter.

I feel like D.P. is overrated. What does it solve? The only thing it solves is the person not getting possible parole since they would be dead or on death row AND the fact that our hard earned money would not pay for them to live in a cell (free tv, free food, free bed). What would be the right punishment? They should never even be considered for release from prison. To be returned to society and have the possibility of raping again. How can you cure a person like that? You can't save someone from themself.

My husband was shot in his back on the job and his boss was murdered by an ex employee. They worked at a mens suit store. Yet this scum from another country has no remorse whatsoever and even laughed about it what he has done. He WAS given the death penalty (we live in Texas) yet now he gets to live because of some technicality he states in not getting to speak with his country. What irks me is- he came to the U.S. to live but instead he chose to commit one crime after another (I have read his file, it's available online) and took someones life and ruined the families. And for some reason he deserves to live on my dime in prison?

This is why our system makes zero sense.

Bet you would not agree with it if your own child was a victim of this unspeakable crime. The child rapist is destroying someone else's life. The fallout is horrendous. The damage irreparable, then there's also the stigma that there's a chance the victim will become a perp.

Edited to answer Marq -- no part of my post was intended to cast a slur on you personally. I don't see where anyone said you were "damaged goods." Irreparable and worthless are not synonymous. I am an abuse survivor myself, and there has been irreparable harm done in my life, but that doesn't mean I think I am worthless and should be shot. Unfortunately, not everyone can achieve the same results as you did. Not every abuser admits to the crime, and not every abuser is even convicted. Not every victim is able to participate in therapy with their attacker or even wants to.

I think it should be imposed. Taking away the innocence of a child by raping them? Might as well have just killed them, at least they won't suffer for the rest of their life that way.

It doesn't matter if someone agrees with the death penalty or not. The question is what is the law.

- The Constitution does not prevent the government from imposing the death sentence.
- The Constitution does not define "cruel or unusual" punishment which means it is left to the Congress: NOT the Supreme Court.

The Supreme Court is wrong and has over stepped their power. If we allow them to dictate law they become dictators.
