Do we have the right to live?

Do we, protected by the US Constitution, have the right to life?

Nothing in the Constitution guarantees anyone the right to live. Some people believe the amendment against cruel and unusual punishment prohibits the death penalty, others believe it doesn't. But there isn't any specific wording saying anyone has a right to live.

The declaration of independence (not part of the constitution) says
"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed"

Often people confuse the Declaration of Independence with the Constitution and quote it as ensuring the right to live.

That depends on how you want to interpret the Constitution. Does it protect the rights that we already have upon birth, or does it grant us rights, or privileges, that can be revoked upon breaking of the contract (i.e. capital punishment)?

WELL SEE.. ACCORDING TO WHAT IVE BEEN TOLD (ON HERE) THE CONSTITUTION IS NO LONGER APPLICABLE AND NOW THEY CAN OVER WRITE IT HOW THEY SEE FIT. SO.. AND IM THINKING THAT... NO WE DONT.. BECAUSE CORPERATE AMERICA IS REALLY WHO MATTERS (OK OK THAT WAS SARCASM) WE HAVE THE RIGHT. NO IFS AND OR BUTS.

Yes. Your life cannot be taken away by the government without due process of law.

This doesn't guarantee life. It guarantees that you get a fair trial before being put to death.

(Since it's an imperfect world, sometimes that means bad guys get off, and sometimes it means innocent people are found guilty. But at least you get the chance to be heard in court, not dragged off and summarily executed.)

Nope. Nothing in the constitution gives you this right.


Saaski is the uneducated one. That phrase is nowhere in the constitution. Even if it were in the preamble to the constitution, which it appears that Saaski has not read, the preamble does not grant, protect or guarantee anything, gives no authority, and has no force of law.
