I'm uninsured and I had my gallbladder taken out last year. I applied for what they called a charity case with the hospital and they paid for half my hospital bill but I still owe the surgeon almost $2100. I haven't been able to pay since I'm on disability and only make $800 a month. They're wanting me to pay $45 a month now and they found out my cell phone number (the hospital didn't have my real number...nobody does, not even my bank) and now they're calling me threatening me. They say they want $45 a month for now and it's going to go up soon since they want me to pay off $2100 in a year and I just can't pay that much money. If I pay even $10-$20 a month, can they still sue me? I'm scared they'll sue me. They want $45 a month and it's supposed to go up in 90 days. I just can't afford it. I'm looking for a job and can probably start paying more in 6 months or so but as of right now, I can't afford more than $10-$20 a month but they're wanting more than double that...and much more. Can I get in trouble if I pay less then the amount they're demanding?

My cell phone is the ONLY phone I have. I don't have any "extra" luxuries. It only costs me $35 a month and is a necessity!

Start paying the 45 a month OR if you cant pay then dont. Let them sue you. Most likely they will right it off as an unpaid debt. It would cost the hospital MORE money to hire a lawyer (who makes something like 100-700 an hour!) to take you to court and file all the papers. They are trying to scare you and it is working.
When they call tell them to STOP calling and to send you all the information by mail only. As LAW if you ask a collections agency (even the hospital counts) to stop calling and send you everything by mail they are required to comply and stop calling! If they keep calling go to your state's website and look up how to file a complaint against a collections agency. |

Unless you pay $2100, you ARE in default and can be sued. GO to the doctors billing office and TALK to them about ALL of you finances. If they actually know you CAN'T pay, they won't sue. They probably will refer you to a financial counselor that will help you make the most of what you have. DROP either the cell phone or the land-line TODAY. You don't need both and can't afford ANY excess spending. |

Cell phones are luxuries, not necessities would be my first piece of advice, but yes they can sue you. Do you think somebody else should pay for your medical bills or something? |

Your cell phone is the only phone you have, yet you have a 'real number' that no one, not even your bank has, correct?
Yes you can be sued. I'd start looking for ways to cut back so that you can send them forty-five bucks a month or let them take it to court in which there's a good chance you'll find your wages garnished and have a judgment against you. |
