Do you think drug testing violates human rights?

I need people's opinions on pre-employement drug testing. Should it be legal? Does it violate human rights?

The testing is not violating human rights in my opinion. It's non-discriminatory and provides protection for the general population that, for example, your kids in kindergarden are not supervised by drug addicts.

It's possible for everybody to get a "clean" test by waiting a sufficient period of time (max. a couple of months). Furthermore, it adds a disincentive for people who use illegal substances.

I think it's a hazzle, and I would personally prefer not to work for a company that does "random drug tests", but I think it should be legal and that it is okay for the employer to have that piece of information.

human rights? You may mean civil rights. Yes it should be legal. If I'm going to hire someone to run a piece of equipment worth millions of dollars, I want to be sure they are not drugged up and destroy not only my equipment, but could hurt someone in the process. This goes for numerous jobs.

I don't think it violates a person's rights. Just as you don't want anyone who's using or shows the signs of using, you as an employee would expect your boss to be drug free as well not to mention more and more employers are requiring drug screening prior to and sometimes soon after employment so don't get mad at anyone but yourself if you get caught up on a drug test. I don't feel sorry for those that do.

I see nothing wrong with PRE Employement testing. It's random testing without reason after you are employed that I disagree with.If a person is obviously high or drunk that is one thing,but to randomly check people afterward is a violation of privacy.But the big companies still get away with it.

I think you need to understand that "human rights" is not a real thing. You can't go to your local library and pull up the list of "human rights."

Human rights are just something that is understood but their is no doctrine of them.

As for drug testing, I don't think they violate human rights, I think they might violate a right to privacy, which is another really tricky thing when it comes to the law, because there is no written "right to privacy" in the US, although it is implied heavily.

For most jobs they can not drug test you even after you are hired unless they have cause. Some jobs like Police, they may require a drug test.

NO ONE WANTS TO HIRE A FIEND. ALTHOUGH MARIJUANA IS GOOD FOR THE SOUL. I'M GLAD I WORK FOR THE PRIVATE SECTOR AND WE DON'T GET TESTED HERE. BUT IF IT CAME DOWN TO MY JOB OR WEED I GUESS I GO SOBER.

I do believe it does to some degree. But if you want the job I suppose it's the company's right to test you.
But I still think your employer cannot tell you what to do on your Saturday night when your off the clock!

No it doesnt violate human rights. Yes it should. Again no it doesnt.

Having worked with a E-head and people that think doing coke (not the drinking kind) is not the most pleasant experience in the world.

in a way yes, because nobody should tell you what you can or cant do with your body, but on the other hand, companies are responsible for you

Yes it does indeed violate right of the individual in many ways. Firstly, by requiring for employment, attendance or other requirement the person being testing is being suspected of of something prior to there being any evidence of the person doing such a thing. This is in direct contradiction to the whole idea of presumed innocence. Another issue is that allowance of drug testing will lead to testing of other things which are not illegal. Now, testing positive for using alcohol can disqualify you from a job, even though the use of alcohol is not illegal. What is to stop employers and organization to test people for tobacco? or fat? Carbohydrates? Sugars? Lactose intake? Insulin? or any other substance that is deemed a potential workplace hazard? What you have allowed is the opening of the door into violation of rights, thus rendering the rights moot and void, for any reason (given enough time) using methods and not under the control of the person being tested that will provide results not scientifically proven to be exclusive to everything except what is exactly being tested for that can be used as evidence against a person. And that is a very dangerous position to take in a society as it opens the door for all kinds of suspicious activities to be conducted by employers and organizations. Now, for those who say, well then don't apply or work for a place that does drug testing or whatever other lame argument they come up with. That is not a valid argument and is a completely idiotic and over simplified point of view as for far too many reasons to list here. However, what people who support this point of view fail to realize is that soon there will be no places that do not have such screening measures and everywhere will be violating everyone's rights, which in turn will lead to most rights being violated for other reasons. Eventually you will end up in a society that does not recognize your right to control (or maybe even own) your own body. Oops... too late... we have that society now don't we! For the most part you really don't have many rights if any regarding your own body anymore. You see, either everyone has rights and everyone respects them or you end up with no one having any rights and society in which everyone must cheat, lie and steal to survive.
