I sent in a complaint against a doctor that took out the wrong side of my toenail which should have been the outside (lateral) that was to be removed permanently! Now the side that didn't need to be removed (the inside of my toenail) is gone and will never come back! So I went and got records and called and asked what does the word lateral mean and they told me it was the nail on the outside of your big toe! So I took pictures of my toe and printed them out to put with my records! He wrote down that he took the lateral part out but he took the other side out!!! I did have medicaid insurance and they told me to call the medical board so I did. If the attorney's that review the case finds the doctor is at fault what will happen with him and/or me?

I mean to say "He wrote down that he took the lateral part out but he didn't write that he took the part out he actually took out which would be the inner nail."

If you notified the medical board, they will likely review the records, the doctor's statement, and any other evidence. They then may take action against the doctor's license to practice medicine. You will not receive any compensation from action taken by the medical board.
If you wish to seek compensation, you would have to consult an attorney who specializes in medical malpractice and file a civil action against the doctor.
ETA: If the medical record does not match the physical findings, and you have photographs documenting the physical findings/that the inner nail was also removed, make copies of the photographs and provide them to both the medical board and any attorney you consult, as evidence of the doctor's wrongdoing. |

If the attorney that reviews the case finds the Dr at fault then you have a basis for a civil lawsuit to recover damages. |
