Does child support garnishment get deducted after taxes, or all deductions?

My husband pays $800 per month ($400) per paycheck. Due to recent financial downfalls, my husband was laid off at Boeing and we had to move from a house to an apartment where he took on a job as a maintenance tech. Our rent is deducted out of our paycheck. After taxes, rent, and child support, he is left with $79. So, I'm wondering if his disposable income starts after his rent is deducted, or if 50% is deducted before his rent. Thanks...

PS - He is only 2 months behind on child support due to loss of job and time lapse before this job. He also has 50% custody of his kids.

you REALLY need to talk to your lawyer about getting that amount changed. we were behind about 5 months (we were in the process of getting an agreement to get it lowered temporarly until my husband got another job) and the judge saw it our way to get it lowered and forgave us for 4 out of the 5 months we were behind. we always paid as much as possible. that looks better for you anyway. it's calculated by the % of his net, or take home after taxes

Did he go STRAIGHT back to court the moment he lost his job to have his child support reset?

This is a mistake NCP's make all the time. Child support is based on his available income. If that changes, so does his support obligation. No court in the country would set a child support order that left a man with $79.

BUT... *until* the court resets support, he's still on the hook for the $800. The ONLY thing that takes precedence over child support arrears is taxes and medical insurance premiums.
