It's protected under the first amendment, for "the right of the people, peaceably to assemble."
Tim, he's asking about the first amendment, not the fifth, which protects people from silence to avoid self-incrimination. |

Of course. I would consider "silence" a form of speech.
Also when people get arrested, cops say, "You have the RIGHT to remain silent". |

I'm not sure what governmental infringement on your right to not talk you're concerned with. If you mean, do you have a right, for example, not to talk at work or not say anything if you are supposed to testify in court, then no, you don't have a right to silence without consequences. |
