Let me explain, I moved into an apartment and that first month was OK, but soon after things stopped working, the dishwasher, the a/c unit (WE LIVE IN THE TEXAS HEAT) the dryer vent is open to the outside yard where children frequently play, so after five months of complaining and no help to fix these problems i left. But my friend opted to stay i told her stay at your own risk and she did but she was not on the lease. I got a call from the owner who lives in Las Vegas and shes threatening to sue me because she found out she is living there. NOW SOME MORE BAD STUFF: the pipes in the walls busted and now the bedroom carpet is moldy and soggy and the wall has a great big patch of mold growing on it, in addition the owner failed to pay the water bill so all tennents were left without water for days, and the plumbing fixtures in the apartment don't shut off they run regardless if they are on or off, also there is this black stuff coming in from the roof and vents that has coated the ceiling fans wall and vents, also one of the ceiling fans has hot open wires hanging from it. THE owner claims she can charge me 150.00 per day for every day my friend stayed in the apartment i did violate the lease terms however, she failed to provide a safe and healthy living environment with no attempt to repair any of the units all with problems like mine What should i do?? BY the way i continue to pay the rent every month (But i cant live in these conditions), i did sign a lease i didn't say i wasn't going to pay it. ALSO contacted the health board and city inspectors and still nothing.... I HAVE MANY PHOTOS FOR YOU TO SEE IF YOU WISH

Get an attoreny son, you have the ball here not the landlord. The landlord is in the worng and you should be suing him! |

You are responsible for the apartment for the duration of the lease, so the landlord may sue you for damages, caused by you or your friend. So, if the burst pipes were your friend's fault, then you are liable.
Cannot charge $150 per day for your friend unless such a charge was a term of your lease. As long as you, or your friend, continued to pay the monthly rent on time, in accordance with the lease, I do not see anything that would legally justify additional monies to the landlord if the only issue is your friend staying in the apartment. |
