Does this woman deserve to go to jail?

Does this woman deserve to go to jail?

She is a hardworking woman who works as a dental orthadoxist at a dental company and she is a well respected woman in the community but she occassionally likes to smoke a little bit of weed.

One time she'd gotten pulled over by the police and the officers asked her if she had something he needed to know about and she admitted that she had a little bit of marijuana (a half ounce) inside her posession and she was being honest, polite and cooperative towards the police officer, fortunately in the state the woman was from a simple marijuana posession isn't an arrestable offense and she has a clean record.

Also do you think of this woman as a criminal?

I think if it's her first offense, no, she shouldn't go to jail. But I do think she should have to pay a hefty fine. Now if she were a repeat offender, then i would say yes, a little jail time might do her good. Would I think of her as a criminal? Not a dangerous one. This is the kind of criminal activity I would take note of, but I wouldn't let it color my impression of her (if it's not a repeat offense). Her best bet would be to just stay away from marijuana, it is against the law after all. :)

Jail time - no! Criminal - depends on the state laws but again, I would say no.

While smoking the stuff is usually against the law, I would find it difficult to name 10 people I know who have never done (or tried) weed.

Half an ounce on one's person is quite a bit and could call for jail time. But this should not label this person as a dealer or a bad person.

Just my thoughts!

If she deserved to go to jail the police officer would've taken her there after she admitted to being in possession of it.

I'm glad the woman is hardworking and has a good job. But, There is rule of law that everyone must follow. if that isn't sufficient enough then the law needs to be changed.

The fact of the matter is that Possession of Marijuana may not have been an arrestable offense in the state that she lives in. However, I think she think she is in violation of federal drug possession laws.

Federal law automatically overrides state law in this matter. I don't think she should be labeled as a criminal. I think this woman needs help verses being incarcerated in a prison.

No to jail and not a criminal. If the last decades have taught us anything it is that sending users to jail only makes for crowded prisons and does not effect the use of drugs in this country.

a criminal is, by definition, one that violates a penal statute. She is, therefore, a criminal. That she doesn't routinely commit other crimes does not change that. The she "likes to" commit the crime doesn't change that, except that if she routinely commits that same crime than she is a habitual criminal. If you want to ask if she is immoral, go ahead. She is, however, a criminal.

Yes. She has willingly broken the current law. She may seem to be a good person but in reality she has chosen to be a criminal. There is noi justification for it.
