EXECUTOR of WILL in need of ADVICE?
Find answers to your legal question.

EXECUTOR of WILL in need of ADVICE?

The hard part is over... I closed the estate; after leaving it open for six months. I was legally obligated to leave it open for six months.

3 months later, a relative of the estate, claims that they've paid a debt on the estate's half; and they want the estate to repay them.

1. What defense may i use? Honestly THE ESTATE never entered into an agreement or contract with this person!
And legally this person is not the executor
This person, never filed any debts within the 6 months of the estate being opened.....
So legally the estate is not obligated to pay this person correct?

Also a month ago, this person filed false arrest against someone; can i use this an example of this person's character... and if so how should i word it? OF COURSE IM GETTING A PRINT OUT OF THE FALSE STATEMENTS/Report

anything else>?

FREEE EASY POINTS
Additional Details
YES THEY'VE ACTUALLY TAKEN ME TO COURT OVER THIS.... mind you 3 months after the estate was closed....

I suspect you have a bond. Make the heir make the first move. They were obligated to get all debts in before it closed. Let them know they are to late. Notices were issued and they did not follow the notice requirement. Good luck.

The plain and simple answer is, as far as you are concerned, your job as executor is over, you have done your duty, paid off all debts, paid the tax man and distributed the estate remainder. If this relative has a gripe with that, then she will have to take it to court for them to decide, but let me tell you, you need not lose one minute of sleep over this, we always find someone that appears from nowhere to claim something from a will. Rest easy.
