Failed to go show up for a court date?

Whats the standard procedure for failure to appear? My lawyer said I did not have to show up for the preliminary but then he said I did not show up. So would appreciate any guidance.

Typically a warrant for your arrest is issued depending on your local and state laws. Just look up your area.

A warrant will be issued for your arrest. Go to the courthouse and let them know that your lawyer told you that you were not required to show up, sometimes the judge will be lenient and dismiss the warrant.

You can get jail time, it's called "failure to appear" and a warrant for your arrest can be issued.

Get a new lawyer though...yours sounds pretty incompetent.

A failure to appear can cause a warrant to be issued by the Judge. There are times when you do not have to appear and only your attorney will. Every state has different rules, and your questions is vague. If you have a warrant out, you can have your attorney set it aside and explain that he told you not to appear. However, it is almost impossible to get an attorney to take blame. Good luck.

First, you should fire your lawyer, then you should hire a new one. When you go back to court, you should explain the situation to the judge, and I am sure that he/she will understand.

I presume it is a criminal and not a civil matter. I have unfortunately had experience with both. You should know of course that procedures and laws differ between jurisdictions so anything I say may not apply because I have no experience with Texas.

One time I had to appear because I was thrown in jail for the weekend, and that was how I was let out. the other time my lawyer went on my behalf; I didn,t need to go. The pre-trial is just for reading of the charges and revealing the basis of (the evidence for) the charge and for setting the trial date.

In civil (family) court, there are all sorts of possible pre-trial hearings that are probably best attended as interim decisions are made based on what the parties present in the pretrial.

Oh, just so you don't think I am a slug, in my first case the charges were dropped, so I was thrown in jail for absolutely nothing except that someone was able to make it happen by filing a baseless complaint (see civil court above to get an idea what that was all about). The other time was a counter accusation to one I filed in a "neighborly" dispute, and I was found not guilty (my counterpart, the person I complained about that started the whole thing, was found guilty and so far that has solved that particular problem).

no fun in any case so I don't recommend it to anyone if you can avoid it.

Usually you get a bench warrant so that means if for any reason you should get pulled over and they run your license just for like a ticket of whatever, you will get hand cuffed and put in jail for the warrant. Just go to court. If for any reason you cant make it call your lawyer and see if he can talk to the judge an reschedual your court date but the odds of that happening is slim. Best advice is prolly a good idea to show up to court if ya dont wanna get put in jail for something as stupid as a bench warrant.

time to ask the attorney -get your money's worth from him. if you feel that he has been negligent in his duties, take your proof to the state Bar Association. get another attorney to advise you legally.

in the past i've been threatened with a bench warrant for arrest...haha...call the police and ask!

Uhh, that's defiantly not good. I would go to the actual court house and talk to them about it.

you could get your sentence longer or even go to prison or juvie depending on how old you are

hm, i dont think you would need to show up for a preliminary hearing, just someone (lawyer) to represent you. but if im wrong, you'll probably get fined
