Filing for child support - my ex does not have a job?

What will the state do if my ex boyfriend isn't working and I file for child support?

Start the arrerage clock ticking based on his last employment and wages.

Garnish his tax returns

Possibly get his driver's license

Possible weekend jail time

If your husband is getting unemployment, a portion of that will be funneled to you. Any income tax he has coming, will go to you.

Even if he has zero income and won't get an income tax refund, you still need to have the child support on the legal books setting a precedent. When he does get a job, you can get a portion of that more easily than if you just file.

The money is not yours it is your children's. You have the duty to file and get a judgment against to protect their rights.
Once a judge orders an amount it will follow him and whenever he works or even wins the lottery he has to pay.

They will be prepared to garnish any wages he does get once he's employed.

If he is drawing unemployment they will garnish that, otherwise the balance will add up and eventually when he does not pay for a while they will put him in jail.
