Just because she has a mug shot and fingerprints taken does not mean that she was convicted it only means that she was arrested and processed. She could have been arrested for the crime and been processed and the DA later dropped the charges. What is sounds like is that she fixed her arrest record and had her arrest removed from record. You cannot get a criminal conviction off your record by simply going to the DA and paying them money, well not in the US anyways, that might work in Mexico. |

Wrong. That just means you are on record. A conviction is when a judge or jury finds you guilty and gives you a sentance or fine. |

If convicted, you can petition to have record expunged depending on crime committed. Her record more than likely is clear now.....not all people who petition for an expungement get it, but a lot do. |

not sure about PA laws, but in AR you can have your record expunged. i did. |

She did not do much of a crime- and yes- she can have it expunged in any state. It is not like she murded somone, robbery, etc. She just got caught smoking a roach , which is a VERY small amount of pot. BIG DEAL, why are you giving her crap about it? She is 100% right! |

Life is SO short ! why NOT just take her word for it and forget about it?? Is it THAT important you you have to prove that you are right?
and BTW , take the word of an old fart - just because you are fingerprinted and mug shot does NOT mean you were convicted - only charged with an offense and YES I do believe that there are services that can DO exactly what she claims (at least I think that they exist here in Canada................so GEE maybe this time you could be wrong eh? |

Having your prints and mug shot taken is something that happens when you are arrested and has nothing to do with whether or not a person is convicted in court which comes later. You can call the magistrates office and ask about the law on expungment for your area. She may have done it all for nothing. |

And yes, it's entirely possible to have a conviction -- even a felony conviction -- expunged.
It's also possible that she was arrested, and participated in a diversion program that prevented her from getting a conviction on her record.

I have never undergone it myself but I believe this just means you are charged, they do the mugshots and fingerprints right away. Your not convicted untill you go to court and found guilty. |

It's possible. Fingerprints and mug shots means you were arrested. Through a plea or the judge the case might have been dismissed without formal charges being brought in which case the arrest record would be fairly cheap to expunge after a period of time.... a conviction would not be expunged like that so she was probably never convicted as that is a petty crime. |

Well, fingerprints and mug shots usually do mean a conviction. However, your local state and county government may have addendums when it comes to what defines a conviction. If she has actually gone to a legitimate D.A. and the official county records state she has cleared her then no, not necessarily.
But I would check the county charter. |

It is possible. About 5 years ago I was arrested for CDV and was convicted. I completed a program and had the conviction removed. It is usually something they will only allow you to do once. It is a way to give you a second chance. |

This, in non-legalistic UK terms is complete balls.
I have been photographed and finger-printed by UK Police for beimg pushed off the road into a feild.
Not my fault !
I now have a permanent record on computer files, that will not be erased. They will not do that.
I feel suspect now to allsorts, even though I am not guilty of any offence.

Any misdemeanor charge can be expunged if it occur while you were a minor, so I asume that is what she is talking about.
Fingerprints and mugshots do not make a conviction either.
If you pay a fine or go to trial and are convicted, otherwise not. |

Was she a minor when this happened? If so it might be possible for her to have a conviction expunged, like the others have stated its not a conviction when your picture and prints are done. If every body that got taken to intake and booked was a conviction there would be a lot of us looking for a way to be expunged. |

fingerprints and a mug shot means there was an arrest made. If your friend has a record then that means there was a conviction in there somewhere. Your friend is probably correct about the expungment, as the DA cannot extort money for personal gain and if they told your friend that is was to expunge the record than that is probably what happened. |

No way, if you are charged with a crime and go to court it's on your record. The judge can choose to dismiss the charges but they are still on record. Usually records are expunged for minors. She maybe had to pay fines for the charges but I don't think you can pay to have them expunged. |

Where I live, one has to plead under expungement from the beginning to have it done. If you dont plead under expungement, then nothing ever gets expunged. She could have been fingerprinted and mug shots taken and still be expunged. Those things would have occurred before a plea was taken. Check in your state and see how it works there. She really needs to be sure. I work in a legal field and people get confused alot !!!!!!!! |

like the others said, you are not CONVICTED until you go to court and judge or jury finds you guilty. everyone who is charged gets fingerprinted and mugshots. |

Fingerprints and mugshots are taken when you are arrested, just because you are arrested doesn't mean you're guilty. You can have your mugshot and fingerprints taken and never be convicted of anything. Besides expungement doesn't really do anything anyways. It makes it harder to find the info, but it doesn't make it go away completely. Your friend is a tool. |
