Over the past few weeks I’ve been ill quite a lot due to my pregnancy. I’ve had to take time off of work because of it, and things have been really difficult. My supervisor has been totally ok with it – he has been totally wonderful. My boss has been away for a few weeks and I’ve always been worried about how she will react when she returns – she’s not a very nice lady.
Anyway, my boss came back to work today, and the first thing she did was go through everyone’s time sheets. She was in her office for about half an hour, and then she flung her door open and demanded that I come in and see her. She screamed at me! She asked me what the **** I was playing at taking so much sick leave, and that I’d better have a good explanation.
What could I do? I apologised and told her that I haven’t been too well recently because I’m pregnant. At that she practically exploded! She started yelling at me and telling me that I’ve got no right to get pregnant, that she’s not paying good money for some “stupid yank ***** who can’t keep her legs closed to go on maternity leave”. Then she told me to get out, and that I’d been fired.
I tried to plead with her but she wouldn’t listen. I said that I didn’t think she was allowed to fire me just because I’m pregnant because it’s discrimination, but she said that first of all, that law only applies to UK citizens and it won’t apply to me because I still have US Citizenship, secondly it’s only discrimination if a man does it, and thirdly that she knows more about business rules and ethics than “some stupid yank” so there’s nothing I can do. Is she right? Is there nothing I can do?

First of all she isn't firing you because you are pregnant. She is firing you because YOU ARE UNRELIABLE. She should have made that clear. You keep missing work, doesn't matter if you are pregnant or have a flu that you can't shake, you are using your pregnancy as the excuse. Her comments about not hiring you so you could go on maternity leave is where you she may have messed herself up though. Second it is discrimination whether it is a man or woman, and if UK rules say otherwise then someone needs to rewrite the laws. |

I seriously doubt she said most of that.
Yes she can fire you but not for being pregnant-she can fire you for taking so much time off.
If she did behave like that, why would you want to work for her anyway? |

Maternity benefits cannot be denied to working women, provided they fulfill the eligibility criteria as per the Act. An employer cannot terminate or change the terms of services of employment during the period of maternity leave. However, the employer has a right to dismiss a woman if she is found guilty of gross misconduct. |

She, man or woman, cannot fire you purely for being pregnant. Either contact someone higher up than her, or go and see a lawyer. Indeed threatening legal action will probably be enough for someone to have a word with your boss about it.
Also, if she has a senior boss I would report her due to her language, attitude, and frankly verbal abuse. You are a legal employee, and therefore have the same rights as everyone else, American, British, or otherwise.
She may know more about business ethics than you, but she obviously pays no heed to them. |

Go straight to your HR department and start the official grievance procedure.
NO, she cannot just fire you, it does not matter whether you are a Brit, Yank or a Martian. If it is employment in the UK then it comes under UK law. |

If you sign in to a company to take a position, and then after taking the job you make the decision to get pregnant, Surely its you that's in the wrong, and not your boss? She would have to face the hassle and upheaval of replacing you sooner or later anyway. Perhaps you should have been straight with her about planning to have children in the first place. It hard to run a business nowadays. you should perhaps bare that in mind. |
