A while back, I bought a laptop from a woman. She said it was infected with viruses and couldn't get it to work.
It wasn't broken or anything, just virus infected. Which can be fixed with a simple re-format.
So being the computer nerd that I am. I decided to run an image recovery program on the hard drive first before I formatted it.
I found some erotic pics that belong to the woman. Now do these photos belong to me since I paid her for the computer or does she have some say to what I can use them for?

A few things.
Pictures as a rule belong to the person who took them. That isn't you, therefore you don't own them.
She had a reasonable expectation that the files were deleted and wouldn't be recovered.
If you decide to use them for nefarious reasons, expect a phone call and a letter from an attorney. |

You may have found them on your computer but the image is of someone who has the rights to them. If you distribute the images she is going to know how they got on the internet. You should return the files to her to avoid getting yourself into a whole lot of trouble! |

It is possible that the woman could claim that she did not include the photos but was only selling you the hardware. This could be a shady area of the law. If I were you, unless you just plan to keep them under your bed for your own private viewing, you remove them from the computer to the fullest extent possible. Should you use them for any other purpose you could be in for a court battle...and considering she did not openly give them to you...I think she would win. |

They belong to her. It is illegal to post pics of a person without their consent. If you ran an image recovery, then the pictures must have already been deleted, which means they aren't yours at all and she probably thought they were gone completely. Why the hell would you want to do something with them to a woman you don't even really know? |

It's tricky. It could be copy protected/copyrighted material. In that case they clearly belong to the copyright holder.
If not, then they belong to the one who possesses them. A gentleman would delete such pictures. That's the safest thing to do anyway. I suppose you could offer her copies before they are deleted, but that could be awkward. |

Although I want to say "No", I can't find any reason why they wouldn't be yours. If she sells you a computer, anything and everything on that computer ought to belong to you, as far as I can tell (Besides identity, of course)...
I don't really see how it's worth the risk, though. Unless they're reeeaaally erotic pics.

NO they are NOT yours. YOU might get sued! Are you welling to cash out $10,000 to $50,000 dollars for using her photo's online or anywhere? You will be exploiting her without her consent! That is against the LAW. Do the RIGHT thing and just DELETE those Pictures today. |
