Freedom of speech?
Find answers to your legal question.

Freedom of speech?

Racism speech is also "speech" and according to the US constitution there should be a freedom of speech. so why do you think racism speech is against the law?
Additional Details
if the constitution says "freedom of speech" then does that mean "your free to say what you want" or "your free to say what you want, except when others don't like it"

There are many examples of hipocracy in the freedom of speech laws. Personally I like the one where you can't deny the Holocaust anymore. People in Germany, Austria are in prison right now for writing history books that do not conform to the standard view. and I think the law passed in the US too, just no one has been arrested yet. How can you dare stop people from looking into history and getting a rounded view? It might not be true, but even so you can't get the whole truth by forcing people to only look at one side of the arguement!
As for the racist thing, it's apearently a hate crime to say racist things to people now and has been moved up to qualifying as assault!
I'm not promoting racism but it's something that needs to be looked at more carefully as more and more infringements on freedom of speech are popping up.

There is a limit for any freedom and that limit is connected by the other people right and there is other thing the society you belong it has it's rules and it's system you should not break, if I was African and you are European and I said we have to kill the white man this is kind of racist the Freedom of speech is not to say what you want only but you have to say it with respect for other people and your society

Racist speech is not against the law. You can stand on the corner and talk trash about another race all you want. Inciting to people to violence or intimidating others is however prohibited speech.

racist speech is not against the law.

the first amendment protects unpopular speech, as popular speech needs no protection

you are free to say it, but that doesn't mean you incur social costs as a result. others are free to respond to you how they will, and you are free to like it or not.

A racist speech isn't against the law in the United States but don't be surprised if someone throws rotten tomatoes at you.

Carl Lewis
there are exceptions to every rule. they are indicated seperately in a small font which no one reads. read the constitution properly

Racism speech is not against the law and is covered under constituional law but violence and disturbing the peace usually acompany racism which is against the law. It is also against the law to speak to someone in a manner that would cause them to fight which includes racism.

If "racism speech" is against the law, then so presumably is anti-religious speech. Or anti-science speech. Or anti-evolution speech. Or for that matter pro-evolution speech or pro-abortion speech.

In other words, speech which somebody somewhere finds offensive and is prepared to take the speaker (or writer) to court over. Or better still is prepared to hassle their congressmen until Congress passes a law banning such speeches.

If some day somebody decides that speeches which talk disrepectfully of whales and dolphins--calling them "fish critters", for example, rather than the much more polite "people with fins"--is nasty and awful and ought to be banned by all civilised societies would it be OK to make "fishy" ("fish-ist"?) speech of that sort against the law too?

Any type of restriction on the type of content a person can write, or say, is an infringement on free speech. It is not really free speech if there is restriction on racism or other controversial subjects. Remember, if you don't believe this type of controversial material should be protected, then you don't believe in free speech.

Yes, we have "Freedom of speach." But it is not a liceince to say whatever you want if it hurts others. Along with this freedom, there are consaquences. Some things are just plain hateful. Just becuase someones skin colour is different thans ours, does not mean we are better than the other person. Besides, who has said that our colour is any better than theirs? We are all in this world together. When it rains, the rain falls on everyone, not just those you don't like.

You have freedom of speech, but it ends at shouting "fire" in a crowded area.

There are limits, as to where you can give your speech and how you give it. It must be peaceful, and not during times like school. Your teacher could send you to the office for insubordination.

I don't think speeches about racism is against the law.

But I do think a racist speech should be.

Technically, it isn't.

"I hate black people! And purple people! And... uh... people from Australia! And everyone named 'Pauly Shore'!"

See, I'm not going to be arrested because of that. I might be banned from Yahoo, but that's not a constitutional issue.

You do have the right to free speech, but you don't have the right to encourage any kind of behavior that will disturb the peace or infringe on anyone's rights.
