Frivolous Lawsuit?

"Frivolous lawsuit" has unfortunately become a cliche in America because of Americans' readiness to litigate the most ridiculous and petty of "offenses". Of course, the greedy and wealthy lawyers promote the idea that there's a "pot of gold" waiting despite the dismissal and/or failure of a huge majority of these cases.

The cost of the lawyer(s) would easily install tall privacy fences and/or pay for many "eating-out" dinners, pool parties or barbeques for the neighbors to gather and resolve the "noise issue".

What ever happened to being friendly to or a bit forgiving of your neighbor?

I watched the samething you did, at first I thought it wasnt right they just kids being kids as you say.

But as I continued to watch it and they played what the recording I thought that screaming was a little too much and the parents shouldve told them to keep it down screaming shouldnt be allowed.

all Kids want to have fun also but it also gets out of hand and eventhough the parents want their kids to be happy they also need to put the foot in the door and take notice that they are being too loud for other neighbors to enjoy and have some peace also.

they also said its been going on for three years, and would you go nuts also if you heard the samething constently for three years?

I dont mind kids having fun but screaming gets annoying.

I just heard the tape myself and really before I heard it , I had my mind made up that it was ridiculous for someone to think a child should be quiet when at play and that it was very petty ...... but then I heard the tape....and it didn't sound like kids having fun to me.... it sounded like them just purposely making noise to irk people....it didn't sound like just normal child's play....besides, their parents shouldn't think its OK for them to screech NON-STOP. A screech from a little girl here and there is normal when at play....but for them to make that ungodly high pitched noise for hours without even sounding like they were taking a breath in between ????? Anyone would go insane!!!!! I feel sorry for their neighbors. And its not the girls fault, its the parents for not teaching them to respect the people who live around them.

people have a right to peace and quite, hence the charg eof disturbing the peace. I personally think it is frivilous but they do have the right, especially if they belong to a homeowners league.

I think the neighbors want a pool also. They just want someone else to pay for it.

I really do not know. It depends on how long it goes on. I used to live next to a person whose dog barked all day long and it does get very maddening.

I am sure that is is annoying for these neighbors but I am also assuming they are overreacting too. I do not think it is for money, they just want peice and quite, but if you move into a neighborhood with kids you have to expect some noise.

The houses are on lots less than 1/3 of an acre and a bunch of neighbors were sick and tired of it as well. We only heard a few minutes of it on tape but the neighbors have to listen to it constantly. We lived next door to shriekers and it truly was a pain.

Every one is sue happy. After a certain time period , say10 PM , 11 PM , yes it might be considered loud. But kids are kids.

That's bloody ridiculous! Probably just a case of some greedy person's latest "get-rich-quick" scheme or a grudge formed over a dinner party debacle!!
Honestly, some people are just pathetic aren't they!!

Wehn I wan younger, my best girl friend and I were obsessed with Super Mario. We'd get really into it and scream when we died. We were kids having fun. My mom was on a cleaning mission, had all the windows in the house open and was preasure cleaning our pool area so she couldnt hear us. Someone called the police stated and reported child abuse. a few cop cars showed up and my friend and i freeked out. My mom was mad but could help but laugh at us hiding in the closet. So ya never know what people will do. This was in the 80's.

That people shouldn't be able to sue for every little thing. I think it is rediculous. It is not only a waste of their time, but a waste of the judges time, and the waste of a judges time is a waste of our tax dollars.

It always amazes me how quick people are to sue someone as their only recourse, and how quick lawyers are to cash in on it. Geesh--why not sue the parents for letting their kids breathe, too?

9 changes out of 10 if they weren't so nosy it would not draw to there attention so much.

Perhaps the neighbors were highly disturbed. What a pity. It's wonderful to hear innocent kids having fun.

I would understand if the noise was offensive but in this case it's just kids living their life.

The people who are suing are idiots. Bet they are suing Pro Se, I can't imagine an attorney actually wanting to take this case.

You are right another frivolous lawsuit. I think the legal profession in the last 20 years has become sinister in its approach to the law just there to make money not the honorable profession of 100 years ago. A judge should immediately throw this type of case out of court and fine the lawyer who brings it to trial
