The father has nothing to do with us, besides paying court ordered support. He tried to get out of support by thinking I was stupid enough to move to NYC so he could get joint custody and not pay anything, never wanted anything to do with the baby after I left him... (6 weeks pregnant) he had only seen the baby once his choice and that's only when we went there and he had made that BS offer.
Just wondering if we were to move to New Jersey, and got married would he know any of this? could he find out? I mean not like he's asking about me or watching me and what I do, he's not but would he find out somehow through payments? thanks.
Oh and me and the baby are both canadian citizens.

He does not pay as of yet, sorry should have been more clear on that. We are in the process now but he has not contacted us since the refusal of that offer to move there, he took a last shot at not having to pay and I didnt let that happen, he hasnt contacted us since, cares absolutly nothing for the child. I took him to court for custody, served him the papers myself and he didnt show,I got full custody denied access, he doesnt care he only cares about his money.

Where and to whom does he send his support payments at the present time? I think I'm missing something here.
Regardless, if you move to the US and the father does learn of your whereabouts, he will most likely be entitled to visitation should he take the matter to court.
If your getting married, your future husband might consider legally adopting your child. If the biological father agrees, this will relinquish his parental rights and obligation to pay child support.
This may be something to consider.
Edit...Perhaps I should be more clear Michael.
The determining factor in such matters is the court and the parties involved. If all are in agreement the obligation of future child support from the biological father CAN in fact be absolved.
If there is an amount in arrears he could still be liable for those arrears. However, it is case by case judgment and often a means for solution to a negative situation. |

Termination of parental rights does NOT absolve the father of financial obligations. KNow that as you step into the realm of termination parental rights.
Will he know that you moved to NJ? Considering that any action you file in court after you move will be filed in the state of residence, yeah, eventually he will find out. |
