Hi, when you go to court to plea innocent, do you talk to the judge person to person at the court or do i get like representative to talk for me? i really do not know how it works. (first time going) . Thanks.

You will appear in front of a judge he/she will read he charges against you and then ask you how do you plead. plead not guilty or ask the judge for a court appointed attorney

Well, I've been imbroiled with the law almost 6 mos. now, and I have not spoken to anyone except my attorney (court appointed) who does not like to talk or answer questions or listen. Anyhow, I've been to court 5 times, and my case is reset for next month for MNCH.

My attorney, the prosecutor and the judge have spoken together on about 3 of my appearances there, and I wonder hmmmmm what could they be saying, and wonder if I'd do a better job representing myself.

Anyhow, just go with the flow, let your attorney do the legal work. He or she will ask you to get a lot of information together. Do that and be thorough. Patience is needed. The wheel of justice turns very slowly.

To answer your question, I have not spoken to the judge person to person. Your attorney will attend with you when the judge asks that question, "how do you plead". You would have discussed it with your attorney ahead of time. Your attorney will be right there standing beside you.

Anyhow, maybe I'm having a bench trial. I have not yet been asked that question. Here's some advice. Ask your attorney about a "bench trial". It could be nice.

Ok your referring to your arrignment. Ok heres how it goes:

1) The judge reads out the information (your charges)

2) If it's summary offence then on to # 3, if indictable on to # 3. If it's hybrid the crown will be asked how they want to try the case

3) The judge will ask you how you want to plea either guilty or not guilty

4) If you plead guilty then you will have a sentencing date set in about a month, the probation officer needs to do a pre sentence report

5) If you plea not guilty; 1) If its summary it will be tried in provincal court with just a judge 2) If it's indictable and carries a sentence of 5 years or more, you will be asked 3 things a) do u want a judge/jury trial in superior court b) do u want a trial with a judge in provincal court c) do u want a trial with a judge in superior court

6) Once your plea is entered a next court date will be set.

I think when you go for the first time, a hearing you can go alone. You stand in front of a judge and tell them your plea. If you Plea innocent then the judge will appoint a court date for you. At that date you need to bring a attorney to represent you unless your representing yourself.
Depends on what your charged with, if its a little ticket or something your court costs and lawyer fees can be more then just pleading no contest. But i guess if your innocent then its your call.
