I purchased 2 coupons from a gym that entitled the holder of the coupon to 3 sessions of massages at a nearby place. I was only able to use 1 session on the first coupon as the others expired before I used them. However, I still had another coupon. They told me that I could not use it again on myself and had to give it to someone else. Seeing as how I paid for it i decided to use it myself and just impersonate my older brother. After giving me a massage they asked me to fill out a form about my info including SSN and sign that I did not falsify any information. I signed it as my brother and left SSN blank. I handed it to them and proceeded to exit the building, but they called me back and told me I needed to wait and talk to someone about filling out the rest of the form. I told them I had other things to do and I couldn't stay, so they told me that I should make another appointment next week and take care of it. I don't think that I'm going to be making another appointment since I don't want to fill out the SSN of my brother nor do I want them to find out that I am not who I said I was on the form. Is there anything they can do? Can I get in trouble? I am under 18. Additional Details Whew, glad I'm in the clear.
I did pay for those massages though... is there anyway for me to still receive them?

I have never worked in a massage clinic that has asked for a SSN. The only feasible reason why they would need such information is if they were filing for insurance.
If you put false information on the intake form, it is unlikely that they will pursue any action unless there is an insurance claim involved. The court cost would exceed any return of profit that they would get out of a lawsuit.
That being said, I would not return to the massage place just because they asked for SSN. That is very strange. |

If you signed your brother's name, you forged it. I don't see them pursuing you, though you probably gave your address and your actual brother's name. Could possibly file charges for fraud. but in this time I'm not sue they would want to do that to a customer. Can you get in trouble, sure you could. You are under 18 so you probably should not have been able to have the massage without a parent's consent anyway so they might be in trouble for not checking your ID or for giving a minor a massage. Had you been injurred or had some physical problam that a massage would have aggravated, they could have been in big trouble. They should have checked the informatin more closely.
However, I would not give my social security number in a time of ID theft. You could probably just call them from a phone, preferably a pay phone so they don't have your phone number and tell them that you won't be back and wont' put down a social security number becasue of the high rate of ID theft and you don't give out your social security number.
I question their taking social security numbers in the first place. Should ask for age, but I'd not give them my birth datte either. I do not figure they have any business asking for it other than to know who you are and your age. But since they gave a minor a massage, I personally, would not worry too much about it.
If this plae was not a decent establishment, you should not go back there. Did you find out if they were licensed massage therapists in your state?

I wouldn't worry about it.
I agree with everyone else, their is no reason for them to require your SSN and being that they don't have a valid reason, you don't have to provide it. If they wanted to confirm you were giving your true information, all they'd need is some form of identification, and they if they had any brains, they'd request it prior to the transaction, not after services have been rendered.
Despite the fact that you abused the coupon, they apparently made no effort beforehand to validate your right to use it. It's not like you wrote a bad check or a stolen credit card. They accepted your coupon as payment, your enjoyed their service, there's not a whole lot to report.

It's doubtful that you can get the other massages. The coupons you purchased expired. Think of it like renting a movie. You pay to rent it, but if you don't watch it before it's due back to the store you've either wasted money and returned it or incurred another rental charge to give you time to watch it. |

First, they don't have any right to require you to give them a SSN. That is truly weird, and makes me a bit suspicious why they would want it. Is this place on the up-and-up?
Frankly, I can't imagine why you would be asked to fill out any paper, especially one swearing that everything was true. And why would they do it after the massage? The whole thing sounds bizarre. Were they trying to get you to sign a membership form?
As for the coupon, I don't think you are likely to get into legal trouble over that--at least I've never heard of something like that being considered theft of services. I think I would avoid patronizing this place in the future. |

if you are under 18 you will not get into trouble for that. from a legal stand point I don't know what the health club could possibly do you as a punishment. they cant and wont sue you for that. being a minor is also an absolute defense under contract law. this sounds like it could fall into contract law. in that case even if there were damage (there was not) the health club cannot recover if you dissafirm the contract before you turn 18. in short there is nothing the health club can do to you short of calling your mom. I would try getting my money back for the coupons. tell them that you are a minor and you a dissaffirming the contract of sale and return the unused coupons. if they refuse take them to small claims court and you will win that case. remember being a minor is an ABSOLUTE defense. |
