My boufriend got caught shoplifting a box of prilosec (less than $20). I know this wasn't right be we are going through a very tough financial time and he HAS to take them . Anyway he got charged as misdemeanor. What is the usual penalty for this? Should he plead guilty or no contest? We obvioulsy can not afford a lawyer, but should he get a public defender. DOes this show up on a backround check for employers. Sorry for all the questions this is the first time he has ever done any thing like this, he really had to have the medicine, he gets heartburn so bad he can not eat. BTW we are in Dayton OH, a pretty big city. Don't know if it makes a diffrence. Any advice is greatly appreciated. Additional Details You know, some of you don't have to be so mean. We both know it was not the right thing to do, but we were under alot of stress. I am not making excuses,but we really did not have a dime to our name, no relatives in the area to help, no insurance, and yes we have jobs!. If you are just going to be judgmental don't answer the question. im sure the people who left snide remarks don't know what it is like to work full time and go to school, and have relatives that are in the same or worse financial shape than you. I hope you learn to be nicer one day.

I actually have worked Loss Prevention in Dayton. I would be interested in which store and what suburb. I never prosecuted people for stealing medicine unless I thought they were re-selling it. Yes you will have a record for this. You will also probably be sued by the store for at least $250 if not more. It will start in the form of a civil demand (a letter) and will escalate to a court case if you don't pay what they demand (yes, its legal for them to do that). You always end up better in the end with a lawyer. It costs the court money to put you through a trial. Is wastes a lot of people's time, so you may be able to get a plea deal. Penalty: probably probation and a fine, maybe community service. I would ask your lawyer about "Adjournment and Contemplation" and see if it could apply to your case (may result in no record). To be completely honest, you stole and you got caught. There is no easy way out of it. I sympathize with you and your financial problems. If you have documented financial issues, you can get a prescription from a free clinic for one of the Rx only meds and petition the drug company to give it to you for free (most will if you meet certain guidelines). You'll get no where talking to the people at the store, so don't waste your time trying to get them to drop the charges. I'd work on getting a public defender or pick-up a second job to pay for a lawyer. If you do end up with a conviction in the future and someone asks you about the shoplifting, I would be honest and tell them you had extreme financial problems and you had no choice but to take the medicine you needed to stay healthy. Its better medicine than a TV. |

Yes get the PD offered in court.
He'll get probation, probably.
I don't think it will show on a background check unless he's getting bonded or something.

first offense? he will be fine just do what the judge says, do you have a 99 cent store? they sell zantac there. its not as strong as prilosec but it works. also if he has insurance he can get a prescription of 300mg from his doc, or have someone else pretend they have acid reflux and get it for him. zantac at the store is also cheaper than prilosec,like 7-10 dollars depending on the brand but they all work. there are natural remedies also like apple cider vinegar or apple cider vinegar pills, raising your pillow in bed, dont eat late at night , change diet and nutrition, no excuse for shoplifting... |

You have two major issues to deal with there.
The first is his heartburn. He needs to see a physician to make sure that it's not something more serious. I don't know what types of medical services are available in Dayton but I'm sure there must be a city agency that can refer you to the appropriate facility.
Ask for the public defender. Pleading no contest is almost the same as pleading guilty. Some employers ask "have you ever been arrested?" The answer will have to be yes. Others ask "have you ever been convicted of a crime?" If your boyfriend has never had trouble with the law, then he could try pleading guilty and ask for mercy from the court. Perhaps a fine or community service and probation and your record wiped clean if you successfully complete the probation. To get a second opinion, you can probably look in the phone book and find free legal advice for "the poor". I know that sounds bad, but there's no shame in being poor. We all have difficult times in our lives and this just happens to be yours.

Most likely it will be a fine and conviction on his record if this is his first time. However it is punishable by 1 year in jail.
If he does not have the Fine to pay they may give him a 30 day sentance in county jail. A public defender would probbly be your best bet.. |

No sweat girl. My friend got caught shoplifting. He probably won't even have to go to court for this. It is a misdemeanor (petty theft) & it will not show up on your background check if he doesn't have to go to court. My friend got caught stealing like $50-$75 worth of stuff & she never heard anything from the store. Chances are it will cost them MUCH MORE than $20 to take him to court & it would be a big waste of time & money.
Tisk tisk -- Think twice before you steal. Ask a relative for some money if it is SUCH an important item. They will understand!!! If you know a medication is something you NEED make sure you put money away for things such as this.
Oh & IF for SOME reason he does have to appear in court (which I doubt he will), have him plead guilty... Honesty is the best policy. Maybe you will have a judge w/ heartburn & he will take is side : ) |

Usually on a first offense for something really minor like that you're best bet is to plead "no contest" because if you plead guilty it ends up becoming a permanent part of your record. A plea of no contest will usually be exponged after a year if you stay out of trouble. A first offense for something really minor like that you might have to pay court costs or a really small fine.
My suggestion on how to get your meds if you can't afford them is to check around your area for a community action program or some other agency that helps the poor and see if they have any kind of a program to help him get them so he doesn't have to steal.

Plead guilty, if you have to....they probably will just send you a fine that has to paid in the mail. When you recieve the fine, call the number they give you to make payment arrangements. You can make as much as you can afford. They aren't bad about that at all. Just make sure you make your payments on time. They shouldn't bother you at all as long as you pay your fine. You don't need a lawyer or public defender or anything like that, you prolly won't even have to go to court. The only way that would happen is if you didn't pay the fine. Don't worry, it's not that big of a deal. Pay the fine and everything should be ok. NO MORE SHOPLIFTING!! It's bad! |

Yes, it'll show up on a background check if he gets convicted. It's against the law, and there are other ways instead of stealing to get things (like thinking about getting a job before doing something to put shoplifting on his record) and the courts are going to know this. They get tons of cases like this, people complaining that they're going through "hard times" and they've heard it all before. Just take the public defender and do what they tell you will be best to do. |

More than likely just community service or in-house arrest, if there are No other past charges. I would contact an County Attorney, and see if the store will drop the charges, and just banned him from the store. You may can talk with the Corperation of the store to see if the charges can be dropped. The store may drop them if he explain's the situation and stays away from the store. I do not think this will keep him out of the workforce. But a felony charge may. |

he will always have an arrest on his record. if he's a juvenile and this is his 1st offense the conviction will probably fall off his record when he's 18 or so. i would suspect he will get some form of either juvenille or adult probabtion. 1st offense 6 months or maybe even a year.
and you are making a huge mistake in not hiring an attorney. a good/decent attorney may even be able to get this thing thrown out/dismissed.
since he took the pills, don't mess with pleading not guilty. hire an attorney and let him work the DA for either a dismissal or a plea bargain. and as broke as ya'll are i would also consider sitting in jail a few days as opposed to probation. in fact, how did you raise bond money? i mean, i assume you can get money somewhere? wouldnt it have been smarter to have borrowed the money for pills rather than borrow bond money?
lets say they offer 90 days in jail or a year probation. (this is just an example. i have no idea what dayton DA will offer) his probation fees will be about 480.00 bux for the year. and that 90 days in jail will turn into about 30 days served. but this is all dependent on if he is adult or a juvenille. GL with it. AND don't let the system just run over ya'll. hire an attorney.
since there was no bond, the state isnt real worried about this at all. i don't know how long it has been since this thing happened, but you may want to try and contact detective in charge of case and if it hasnt been filed yet, see if an explanation/appology/ wont-happen-again may get it squashed. if it was a big store, walgreens, walmart etc, they may have a company policy that will insist on prosecution, but you may try talking to them too. you know? try and end it before it begins.
one more thing then. i guess he was ticketed for shop lifting right? if he wasnt ticketed, they arent even going to file it. if they do, he's looking at 90 days probation and after 90 days no conviction and maybe a 100 fine; but he will have the arrest on his record but no conviction unless he violates probation.... |

Yes it will show up on a background check. Utilize the public defender...we pay taxes for that. Find a public health clinic, he can probably get his meds free or very cheap. |

I had a family member go through this. He was 21 and he stole a 5 dollar tie for a job interview. He was arrested, and had to post bail. Your situation is slightly different, but I ll tell you what happened when i went with him.
Assuming he has a court date, he will go to court, the room will be packed. The judge will call his name, after many hours of waiting, he will approach the bench, the judge will read what had happened, ask if he has anything to say, then read his sentence. In my scenario, he got fined $540 dollars. The judge will ask if you can pay it immediately. If you say no, he'll allot a certain amount of time to pay it. We had 10 days. If the fine is not payed in that time then he will be arrested and serve time. I wouldn't get an attorney if the situation is like the one i went through. It isn't necessary. It is very similar to traffic court. Good Luck.
Oh and no, it doesn't show up on background checks, at least not in my situation. It is as though he got a traffic ticket. Those don't show up on background checks and neither did my family members misdemeanor offense. All I know is what happened in the scenario that i went through. It's expensive and embarrassing but it wont ruin his life or yours. No one will know unless you tell them! |
