I am 18, I do not go to parties but i was convinced to go to one and a friend got me to try his beer, I had 1 sip. (hated it)... anyway the cops came and I told them that I had one sip. They gave me an underage but gave me a subriety test and told me to DRIVE home. O.K. so what do I plead? guilty, not guilty, or no contest? by the way the agent lied on my ticket and said that I admitted to drinking 1 beer, is that relevent? ANY help would be much appreciated....

He wasn't charged with driving drunk or being drunk just possesing alchahol as a minor. He is guilty and he tole the officer he was guilty. The officer is simply going by his word.

UNDERAGE DRINKING LAWS
Minors who purchase, attempt to purchase, possess, or consume alcoholic beverages, as well as minors who are intoxicated in public or misrepresent their age to obtain alcoholic beverages, face the following consequences:
Class C misdemeanor, punishable by a fine up to $500
Alcohol awareness class
8 to 40 hours community service
30 to 180 days loss or denial of driver's license
If a minor is seventeen years of age or older and the violation is the third offense, the offense is punishable by a fine of $250 to $2,000, confinement in jail for up to 180 days or both, as well as automatic driver's license suspension.
A minor with previous alcohol-related convictions will have his or her driver´s license suspended for one year if the minor does not attend alcohol awareness training that has been required by the judge. |

drinking is dreaking i havent drank in over two years I'm 48 years old and it has caused me nothing but problems.Dont let anyone tell you it cant happen to you.Plead no contest,remember this ain't the judges first day,he's done this for years.Be honest,most of all be honest with your self. |

It's legal (but stupid) to drive if your blood alcohol level is under .08 so it's okay that they told you to drive. I would go to court and plead guilty with explanation. Tell the judge (if he'll hear you) that you only had one sip. He may not care, since you technically did drink, no matter the amount. This should be a good lesson in not giving in to 'peer pressure'. Well, it seems that you've been put into quite a stressful dilemma. Not guilty would be the way to go for this one. Tell them about your past experiences with drinking and how there weren't any. Tell them you never usually at parties and that it's not your place. Also, mention any sports that you are involved in. Authorities will like the fact that you have a well balanced life. Mention that you wouldn't dare jeopardize your athletic career. Also, it is extremely important that you explain the police officers mood with you when you spoke at the party. If he was mad, of course he won't give you any slack and write you down as 1 beer consumed. Get the officials no reason to get you in trouble.

He told you to drive home, but opened a case against you? If this was his intention all along, it's likely he would have recorded your BAC, which cant have been more than .0001 after one sip of beer. You're fine. |

If you didnt blow into a breathalizer I would plead not guilty...They have no proof... Your word against theirs, plus they let you drive away.. NOT GUILTY |

Well you would have to prove that the cops told you to drive home to get the charge dropped. You should just plead guilty and get your plea bargin...its really not that big of a deal! |

Umm that guy who typed the whole drinking law is showing what is the law. the fact that you were at this party and all this underage drinking was going on there. courts going to throw the book at you. my best bet would tell them that the cop made you drive home. But if you do plead guilty they ll make you take some test to see if you have or had or if your family has had any drinking problems. if they think your not a big time drinker you'll just have to pay a fine. but if u answer some questions wrong on the test you'll have to take classes... and tell the judge you had 1 sip. if they don't take your word there test to see if you have had any beers before this ticket. |

you should not have said anything, there are a lot of ways to get a register on a breathalyzer like cough syrup and asthma medication. and in CA under 21 and driving blowing anything on a breathalyzer is a automatic DUI, not sure what the laws are in your state, if similar you could use it against the cop, hell you could deny the whole thing if there were a lot of people, say it must have been someone else. BUT before doing such a thing check and see what penalties you might get, it might be easier with no contest. |

Sad but true, IF this person was a real friend he would not have put you in this position, he was putting you down for his own reasons.

It doesn't matter what he said you will still have a chance to clear it up. Get thee to an attorney and see what, if anything can be done. Oh, BTW, ask for a public defender, if you are not financially able to afford an attorney, don't try to go it alone. |

You shouldn't have said anything, Ok if when they asked you if you drank beer and they hadn't read you your rights yet anything you say can be dismissed in the court, also you can plead not guilty and just talk to the judge and tell him your story, or you can just lie and admit to nothing, but if the officer had already read you rights and you answered the question then it can be held against you |

Not guilty, since they have no physical evidence, (unless they video taped you or gave you a breathalyzer test) and you will most likely get it thrown out and he might not even show up if its a big city. So talk to your families lawyer and see what they can do but I would plead not guilty if they have no evidence. |

You should go to court and tell them the truth. Say it's not true you drank a whole beer, and if they thought you drank a whole beer why would they be telling you to drive home? That's endangering your safety and they can get in trouble for that. If you had only one sip then tell them that. You should get off fine. Nothing that bad would happen anyway, even if it was one beer. Kids drink all the time, and way worse than what you did. Don't worry, everything will be okay. |

Just say you had a sip. My dad gave me a sip when I was 16 once. It didn't hurt me. Yes the 1 beer would be a difference. I would plead Not Guilty... because you really weren't drinking,,, you were sipping... I doubt that if you explain what happened and are honest they'll punish you... you'll be okay.

that must have been a bad party if the cops crashed it.
i live in a stereotypically boring town, i dont wish to reveal the name, and my friends and i party alot at my place. our town is real quiet. we have fun inside no doubt but we aren't too noisy; most people can't tell that we party inside my place or friend's places.
I never had a run-in with a cop, ever. not in that way anyways. which means me and my friends never had a crashed party.
i would plead not guilty, and police trumping up charges is a crime- go to a lawyer for both. |

did he give u a breathalyser?? cause u can object to the 1 beer cause he has no proof that you drank besides that you told him the 1 sip and if that is not on the ticket than maybe u can fight it |

If he gave you a sobriety test and told you to drive, the cop deemed you were under the legal limit for drinking and driving. Did you blow into a breathalyzer? Did any alcohol register on the meter? If so, you're guilty of underage drinking, doesn't matter how much you drank. After your friend told the cops you had a sip, did the cop ask you personally if that was true? If so, did you admit it? Then you're guilty. If I were you, I'd take it with a grain of salt and plead guilty. You won't get hit hard if it was your first offense. You could try to play the system if you plead not guilty, but if you're a first timer, don't push your luck. |

If you passed a sobriety test, plead not guilty, the burden of proof is on the state to prove you drank anything, and if you had not been read your rights, your statement is not admissable anyway. Make the state prove, yu drank at all. they cant... |
