Ok, my wife was working at a restaurant, we are going through the immigration process, so she is not YET able to work legally. Well,she was constantly being harassed by a co-worker, and he made a comment that he would hit her in the belly to kill our baby (she si newly pregnant.A little under 3 months) The manager does nothing, says nothing about this guy, so I went in there and set him Straight because the manager would not say a word to him. I did not lay a finger on the guy, I just warned him. So, her co-worker calls about 156 minutes after I leave the restaurant and says that he has fired her for me going to talk to her co-worker. Is there any action we can take against this?

Your wife shouldn't have been working illegally and if this comes to light, it may affect her ability to emigrate legally to this country...so no, there isn't anything you can do about it. As it is, if they know she is illegal, they could get in trouble for having hired her, but they can also turn her in for working illegally.
Now if she had been legal, you could have gone to the cops as threatening to assault a person is a crime...but you can't afford to go to the cops because your wife isn't legal yet and she was doing something she shouldn't have been doing (working without permission).
By the way, how could the co-worker have fired her? I thought you said she had a manager? So who had hiring/firing authority? Or did her manager fire her and you just got it wrong above?
As for action...unless you want to get your wife removed from the country, there is nothing you can do. And I strongly suggest that she obeys the laws of this country and NOT continue to work illegally (under the table). |
