I worked fo the NHS I was on a fixed term contract for 12 months which started on July 2007, it was extended by 6 months verbally I was told last week I had to apply for my job back but I was to leave on the 13th of April, I applied for my job back but did not get it totally unfair

Of course it is NOT unfair.
You had a 12 month contract which was then extented for six months, you have already had a couple of months extra anyway.
You cannot be unfairly dismissed if there was no contract in place and it is likely that the terms of the contract would not allow you to claim this anyway.
You were not applying for "your job back" you were applying for a job (new contract).
You never got it - not unfair at all. |

If you were on a fixed term contract and it was for less than 2 years (and hadn't been extended to 2 years) they can be as unfair as they like. |

Judging by your times, your extended verbal contract of 6 months had expired.. You started in July '07 and your initial contract would have expired in July '08. a further 6 months would have taken you to Jan '09.
This unfortunately is how the NHS works... They take on a lot of temp staff, don't offer them permanent contracts and that way they are under no obligation to keep them on should they need to cut costs. |

Totally fair, in fact. Your initial contract was July 07 to June 08, extended to Dec 08. In fact they've been keeping you on beyond this date. It's standard practice to reapply for NHS jobs, there's no guarantee you'd get it as your application for the post will be considered along with all the others. |

Having worked on a fixed 12 month contract, and then extending it another six months whether verbally or written, it was still a fixed contract.
As it was within a two year period they can do pretty much as they like. |

totally not fair unfair dismissal take them up my brothers going thought the same thing he had his contract terminated as he was sick and he has all doctors records sick notes medical records to prove it and hes an enginer and cant get his job back appeal the unfair dismissal thought your solicitor it will be a long battle
i hope you get your job back to many people out of work
