Okay, so I'm a senior in high school, and today I heard a rather nasty rumor about a guy who graduated last year. But, by the time I heard this rumor, a ton of people already knew and were talking about it. I did tell a few people about it, but not many. And like I said, a lot of people already knew.
But then, this afternoon, I got a very strongly worded text from a girl I used to be friends with (who also graduated last year) who is good friends with the guy the rumor was about, and who might have even been the one who started spreading the rumor (but I'm not completely sure about that). She told me to "stop spreading rumors that aren't even true just because I'm bored with my own life." (but it was a lot more vicious than that...). Now I was honestly bewildered when I got this text, since I only told a few people, and people were already talking about it before I even heard the rumor. But I decided to ignore it, since I really hate drama and didn't want to get involved.
But then a few hours later I got a call from the guy who this rumor was about. He left me a voice mail, and he told me to stop spreading the rumor (which I haven't been) and that he's been getting harassed by someone about it and he filed a complaint against them or something. He then threatened to SUE ME if I didn't stop "spreading the rumor"!!!!! And I still have no idea why he and his friend think I've been spreading it!!!
So I decided I could do one of two things. I thought about messaging him on facebook (since I deleted his number from my phone) and tell him that I haven't been spreading anything and clear my name, or I might just ignore the whole thing and wait for it to blow over. But what should I do???

Don't do anything, because they're all morons. You can't be sued for repeating a piece of gossip. If they can prove you'd been harassing them, then they might have a case, but it looks like they're the ones harassing you. Drop it. |

If you're truly worried about it, and it sounds like you are, I would encourage you to speak with an attorney about it. Most attorneys give a free initial consultation...but, check first, don't just 'expect it'. Follow your attorneys advice...and stop stressing about it. |

Did you repeat it in writing (that includes text messaging)? If so, he could subpeona that from your web/cell provider (and yes, they have copies of EVERYTHING, it's the law). His lawyer would still have to prove that it was not common knowledge before you spread it. But your lawyer would need to prove that other people already spread it first. In that case, if someone texted you or emailed you, SAVE IT or at least make a note of the date and approximate time (in case you do get sued, your lawyer will appreciate that info).
If you didn't do it in writing, it could just end up "he said/she said", and considered hear-say (inadmissable).
But in general, just don't spread rumors about anyone. Their business is their business, even if they are a total idiot. You don't get involved by not repeating it. |

Call him and tell him that you are not spreading rumors about him and that someone is spreading them about you spreading that rumor and you are pissed and that someone, even him is going to get sued of this! |

The kid must have dropped out of high school. He can sue anybody he wants but that doesn't mean he will win.
There is no way he can prove this.
Let him sue. Contact him and tell him. Go ahead and sue me you dumbass and I will sue you for wasting my time with a frivolous lawsuit.
The burden of proof is on him. He can not sue you for slander and he can't sue you for libel since you didn't write anything about him that he can prove came from you.
Just remember this. No one can sue you in court over an "opinion".
Since an opinion is not something you can disprove. Since an opinion is not falsifiable.
you can talk all the smack you want about him. Just say "In my opinion..." in front of everything you say or write.
Put in your additional details what this idiot supposedly did. And I will spread it around the world so everyone knows about it and he can try and sue me that **********. |

Tell him, in person preferably, that you did not spread the rumours.
Also note, you can only be sued if the rumour being spread about prevents the person from enjoying his quality of life (ex. stops him from finding or keeping a job, stops him from being sociable, etc.), and if it does go to court he must prove it to the judge how it stops him from enjoying his quality of life. |
