Help with some Business Law homework please ... :) ...?

One of my assignments is to go to google and find an example of a case where someone has been let out of their contract because of Intoxication.

When search for "Disaffirm contracts due to intoxication" .. all I get is what it means, not examples of cases.

So, my question is..

Do you know where I can find an example of one of these cases?

Thanks!!

Mr Placid
Good luck with that.

Such cases are exceedingly rare. You likely will not find such a case anywhere on the internet.

I suggest using the ever-popular Lucy v. Zehmer. (You can find that on the internet.) The defendant wasn't able to rescind the contract in question due to intoxication, but he did assert intoxication as a defense. The case at least explains why intoxication was not a successful defense.

Lucy v Zehmer cites another case, Taliaferro v. Emery. In the Taliaferro case, the court *did* rule that the defendant was too drunk to accept a contract. However, that case is so old that you will probably need to go to a law library to read it.

Excellent suggestion, Mr. Placid.

Write down the following and take it to your courthouse law library. The librarian will help you find the case. Then you can photocopy it to read it at home, or take notes while you're there.

Taliaferro v. Emery(1919), 124 Va. 674, 98 S.E. 627
