Hi, How do I sue a big company?
Find answers to your legal question.

Hi, How do I sue a big company?

like coca cola , or Pepsi for advertising controversial articles on their products about my country and its weird culture which is completely wrong . I had called them in July 2007 and they have send me an apology letter for it but still it's coming out in the market and its very embarrassing. .

I don't know where you live. If you live in the United States, you can sue them in your local state court or in Federal court. I would recommend you speak with an attorney as to your chances of having a favorable outcome in court. If you live in the United States, you must know that corporations have the same rights as people. Therefore, the corporations have the right to free speech.

If you live in some other country, you will have to speak with a local attorney about what rights you have and the corporations have.

It's very difficult to sue a large corporation like that. They are so rich that they can hire the best lawyers, and you are likely not rich enough to hire a team of highly skilled lawyers.

If you do want to sue them, you'll have to make sure you have a really good case. If you find a lawyer who believes they can win the case, they may opt to work for a percentage of the winnings.

However, it honestly does not sound like you have a very good case. You can't sue a company for insulting your country. For one thing, why do you have a right to sue them anymore than anyone else from your country? What they printed may have been wrong, but you're not going to get any money out of them for it. If they had insulted you personally, that would be a different story entirely.

You can't sue them for something that does not involve you. You aren't thinking of suing a company for not telling the truth in advertising, are you? You could bring down civilization!

bossdave
No offense, but save your breath to cool your soup. These corporations have entire armies of legal staff. You can't afford to take them on. They'll run you straight into the poor house.

Then take out an ad in the New York Times or something if all you want is to tell people that you eat oranges with the peeling off... Suing them for that will get you nowhere, sorry.

edit*** Your best bet is just to get over it... You're going to waste a lot of time and energy trying to spread your word, and it's not going to matter in the end...

Look at it like this... the company is ignorant if they don't have their facts straight.. just laugh at them and don't sweat the small stuff....

I would think orange peels taste very bad, but if that's your custom, then I wouldn't think any less of you or your country.

get a big lawyer!

prince_henry
you can not sue them, coz you can not prove that no-one in your home country does not eat a orange in this way
and also you would have to prove that them saying that some people did was detrimental to you.
you don't have a leg to stand on, I'm sorry

you really need to get a good lawyer who will do it for free because if you are working they will charge you and not give you legal aid the best bet would be to enquire about it from different lawyers

The chances of any non-American succeeding in suing an an American corporation are virtually nil. The US may claim to be the leading free trade nation but they routinely ignore anyone outside the US and engage in massive protectionism.

I'm afraid to say that:

1. You cannot sue them for the matters outlined in your question, you simply have no cause of action. Your claim would be struck out almost immediately.

2. How do you sue them? Simple, go to your local court, fill out a claim form, pay the issue fee and wait for the avalanche.

If you're going to sue someone, sue on the basis you have at least a snowball's chance in hell of winning. This one doesn't.

sugarplum
You sound very sincere and maybe have a genuine grievance. However, in such a case it's best to stay away from any thoughts of suing. Money wins out.

joan k
Sorry but you would just not have enough money to sue them. Try reporting them to the Advertising Standards Agency.

First of all you have to have a case, and can prove that you were damaged financially or emotionally.
Unless you lost your job, or ended up in the hospital because of this you can't do anything.
Just buy Dr. Pepper instead. Make a big point at work of walking around peeling your orange, saying loudly, "MMM, I love peeling my orange, it tastes so delicious without the peel! We always do this in my country."
Good luck.

We don't like strangers
You disgust Me. This money You expect to win in the courts, planning to share it with the country in question? Or were You going to keep it all for Yourself and become what You set out to destroy?
