i was stopped a sobriety checkpoint. admitted to having glass of wine mixed with fresca (i know lame) they were statecops pretty sure rookies on the field sobriety test reports say .08. on the "batmobile" the results were .07 .15 and .07 the officer told me on way to station i blew a .06. i did fine on other tests but he says differently of course, never wrote me mixing fresca with wine, and botched up the report with wrong day, said my car was full of minor scratches and dents(its brand new yr old very few marks on it). so i am hiring lawyer. just how much should a case like this run me? i live in mass talked to one of the best worcester county lawyers very pricey? does this sound like an easy case...

If the Police Officer determined that you were impaired he can cite you , even if your blood alcohol is less than .08.
I recommend that you interview several attorneys who specialize in the defense of drunk driving. |

It's called under the influence. Just because you may not be "legally" drunk does not mean your ability to drive has not been hampered. This is also how they get to charge people who are stoned or on other illegal narcotics who operate vehicles while "high" |

You can be charged at any blood alcohol level if it can be proven that you were impaired. |

I believe they can charge you for reckless driving. You didn't hit the .08 so they can;t suspend your license or take you in on the spot. .07 is pretty close though, so you must have been drinking so you probably weren't paying attention to speed or something. |
