Both have breasts, just men have smaller ones. What if a woman had very small breasts? Or a man had large breasts?

Women's breasts are considered as part of a reproductive type organ because they produce milk for nursing a baby. Men do not do this.
On that note, if a man with very large "breasts" is going topless, that should be a crime on its own. |

Because of decency. Citizens of a state are allowed to set standards of decency. It has nothing to do with rights; free speech is also subject to standards of decency with regard to time, manner and place.
And it's not illegal for a woman to go topless, it is illegal for a woman to go topless in a public place. What exactly is public and what is private has to do with the question of expectation of privacy. If I want to go topless in my backyard which has a high privacy fence, and someone goes out of his way to look at me, then he is committing the crime, not me. |

It is LEGAL in NYC for women to walk around topless....if you try it they will arrest you though....you just have to point out the fact that you aren't breaking any law... |
