Juries are very old in law, not even close to starting in England.
Ancient Greece had juries, as did ancient Rome. In Greece the Juries also had the power of what we consider judicial review, meaning they could find legislation against the laws (unconstitutional).
However, the modern day jury system did start in England, before the Magna Carta, in a document called the Clarice of Clarendon in 1166. Even further than that to Normandy before William the Conqueror invaded England.
Also, the US court system is not at all based on English common law. The US legal system is based on English common law. Common Law is basically the written opinions of Judges and treatises of scholars, like Coke and Blackstone. |
