My ex signed a promisorry note stating that he would pay a certain dollar amount for the next two years to pay me for the house we jointly own. He has cut his agreed upon payments in half and he wont change it back. He has full use of the house. What are my legal rights to get the money?

I feel that there is much much more to this story than you are telling. It has been my experience when dealing with these issues that..1..when someone "cuts" payments less than the agreed amount it is due to "the person doing the cutting" not being paid for "services" they are doing... such as upkeep, mechanical work, property investment work or "other favors". 2.. you verbally agreed to a lower payment and once you got mad at him raised the payment back to the original amount.. which.. puts you breaking the contract not him. I hope this helps the situation. |

Legal matter belong in front of judge to settle, to enforce this agreement with the ex. consult your lawyer |

See if it was covered in the divorce decree/ settlement, in which case you can just go back and ask that he be held in contempt of the order.
If not, you're headed back to court to enforce the note. |

if he signed the note as part of your divorce decree, you can go back to the court and get an order to seize assets he possesses to satisfy the note.
if the note was for some other consideration, you can file suit to end the consideration or otherwise enforce it. That this may mean his eviction so that the house can be sold is something to discuss with your attorney.
if there was no consideration for the note, you probably can not enforce it.
Thus, you need an attorney in your state for further advice. |

If you have his signature on an agreement, you can send it to collections. Better yet, just send him an official lookingletter threatening to send him to collection. |
