Look... what can you do? He says he doesn't have them. The cops aren't gonna go turn his house inside out for lack of a crime. You're gonna have to trust that he is telling you the truth. I would suggest maybe asking him that in the event the pics ever do show up that he let you know so that you can arrange to get them back from him at that time.

You could sue him to get them back, but you'd have to prove that he has them to return to you.

You are probably out of luck. I suppose you could sue him for the custody of the photos, but it's your word against his and it would only serve to bring your mistake out into the public eye.

C'mon now, seven years is a good bit of time for things to get lost/misplaced so it's likely that he's telling the truth. Besides, 17 is close enough to 18 that it would be difficult, if not impossible, to prove that you were a minor at the time the pics were taken unless the prints were date-stamped by the processor or the packet containing the negatives and control number were likewise dated.

Unless you signed a release, they do belong to you. But what are the chances that a 21 year old guy kept up with anything after seven years, let alone a hand full of pictures.

You can threaten him with a lawyer. You can write a letter telling him you are giving him a certain number of days to come up with them before you consult an attorney. If that doesn't work, consult an attorney if you are comfortable with letting another person in on this (besides everybody on Yahoo answers).

If they do ever turn up anywhere, you can try to sue him, as he has no signed release and you were underage.

It all depends on whether it was a bad breakup or an amicable one.

i am not going to lecture you i am going to help you! call the cops if he doesnt give you the pics back and when you call them say that you were and underaged minor something like that!!! youll be fine just be careful please!!! and in the future dont do that again because you are going to have to deal with this all over again!

Did you know the age of consent varies from 14 to 18 depending on the state?

Anyway, You won't be able to scare him into returning them.
The best you could do is appeal to his sense of honor.
