How do I prevent neighbor from removing fence?

First question - EXACTLY where is the fence? Is it on the property line? On his property? On your property?

IF it is on the property line, I would think you own half of the fence. In which case, he cannot legally do anything to the existing fence without your approval. If this is the case, send him a certified letter (cost $5 with a return receipt to you which proves he received your letter) stating you are part owner of the existing fence and you do not want anything to be done to the fence.

If the existing fence is on your property, then he has no right to touch it. So a different letter stating its 100% your fence and you do not authorize him to touch it..

If it is on his property, the only thing you could do is check with your local Building Inspector to see if there are any restrictions on the type and height of fences for that type of lot. Also check with the Planning Commission and see if fences are allowed and what type of offset (how many feet do they need to be away from the property line. If he violates these restrictions, contact the Building Inspector or Planning Commission and they will make him rebuilt the fence to what is allowed. A expensive task.

If the neighbor expects you to pay half the bill, then it has to be something you both agree on. If he wants to change the fence and you don't want to, he is on his own.

put them side by side- his privacy fence of his side and the old ne on urs. make him pay for the full price of the fence-u dont want it, y shud u pay?

If he wants a new fence, let him buy it himself and make sure it's on HIS property. If it's on your property then you can just say screw you to him and say that it's your property and he can't do **** about it.

dont pay. If he still insists on putting on the fence, then tell him to leave the old one on and put a new fence on his side.....or you could always sue his ***

If the neighbor wants a new vinyl fence he gets to pay for ALL of it and it gets placed on the other side of the existing fence. Otherwise he is going to have to pay for a survey to be done to prove that the fence is on his own property 100%

First -- whose property does the fence reside? Second - your neighbor needs a permit, no permit you can contact your local town planning and zoning and notify them that he is building without a permit, big big fine. When he pulls the permit, you can complain to stop it. At the end of the day if its his fence and property, not much you can do. You don't have to pay for anything.

If it's on his property, I don't think you can do anything. If it's on both your properties, I think you would have to consent. Also, I've actually heard of people taking their neighbors to court because of "eye sores" and bringing property value down, etc. You might need to hire a lawyer to stop this guy.

If you want to keep your fence, I suggest you get a survey...and consult a lawyer. By the way, if your neighbor tears down your fence without your permission, he will be fine if it is on his property, not fine if it is on your property...but if it is on the property line, this is going to end up in court! So stop guessing and find out for sure...get that survey and consult a lawyer!
